Aren't Automatic Knives Illegal Everywhere?

Gentlemen, I'm rather new to this knife collecting thing (about six years), but I thought automatic knives were illegal throughout the U.S. for all people except police, military, fire, and EMT personnel, yet I see them being offered for sale in online auctions with no mention of any restrictions as in the gun auction sites where transfers have to go through FFLs (i.e. Federal Firearms Licensees). Am I wrong?

Thanks in advance for any help you can provide.

No autos over 2" in Nevada.

There's several states where you can carry an auto. Some require the knife to be visible (ie: not concealed).

I lucky and happy to live in a state where I can carry whatever I want.

Something to understand though is that interstate commerce of switchblades is federally banned. Even to states where they're legal, and even between states where they're legal. For example, I can buy and carry a 2" auto in California. But even though autos of any size are legal to buy and carry in Arizona, I'm breaking federal law if I cross the CA/AZ border with it. Go figure.

You are only breaking the law if you cross the border with the intention of selling it to non-LEO or military. You may buy an auto in AZ and travel with it to CA so long as it is for personal use only.

Oh really? Not that I travel to CA often (or ever).:)

The federal goverment only has the power to regulate state to state commerce (ie sales) on this matter. If no sale is taking place the Feds have no say in the issue and it becomes a matter of state law.

What you can't do (in CA at least) is buy an auto in AZ, drive it into CA and give it as a gift to a friend in LA. That is a violation of 653k if the auto is over 2".
