GOODWATER, Alabama | Thu Feb 3, 2011 11:18pm EST

GOODWATER, Alabama (Reuters) - An Alabama police officer shot and wounded a defendant in a small town courtroom after he tried to grab a gun and attack a judge, authorities said on Thursday.

But three witnesses gave a different version of events at the municipal court in Goodwater, a town of around 1,500 in central Alabama, northeast of state capital Montgomery.

They said the officer used unnecessary force in twice shooting a defendant they said became unruly but did not attempt to get a gun and was anyway on crutches with a broken hip sustained in a car accident.

The second shot fired by the officer was unnecessary because the defendant lay prone, they said.

After the first shot the defendant "slid down real slow. The officer took two or three more steps and shot him again," William Allen, 20, who was in the courtroom's third row, said in an interview.

The Alabama Bureau of Investigation said the defendant: "attacked the Municipal Court judge and attempted to forcibly obtain a firearm when he was shot by a Goodwater police officer who was providing courtroom security."

The bureau, which did not name the defendant, based its statement on a preliminary investigation of an incident it said took place at around 9.39 a.m. local time. Witnesses said the defendant was local resident Brian Ford.

The wounded man was taken by ambulance to Sylacauga and transferred by helicopter to University of Alabama at Birmingham hospital, the bureau said.

Ford was in surgery at the hospital on Thursday afternoon, said hospital spokeswoman Nicole Wyatt.

Sara Williams, 69, a retired ambulance driver and fire fighter from Goodwater, witnessed the scene from the courtroom's front row.

The defendant shouted at the judge after he was sentenced, swung his crutches and "got real disorderly", provoking a melee but posed little threat because he was on crutches, she said.

People screamed when the first shot was fired and shouted at the officer not to shoot again but he told them to clear the court, "stood over him on the ground and shot him again," she said in a version similar to that of other witnesses.

"It was senseless to shoot him twice. I could have knocked him down," she said.

Police in Goodwater and the Coosa County sheriff's office declined to comment.

original story I heard on NPR said he was charged with harrassment but didn't get more specific. Sentence was $800 or 30 days.

Wow, that sounds pretty insane, but they guy did get "real disorderly."

God bless,
Adam

Sounds like a terrible abuse of power only reading what was posted. Hard to judge what use of force is needed unless you are the person there.

Them crutches is dangerous. Let me swing one of mine around a bit and you will agree!!!

It's always a shame when people get hurt. The officer might have over-reacted. The defendant certainly did. Do not antagonize people with weapons. Ouch.

Hopefully the court system in Alabama is similar to the system here in Ohio and uses video recordings of all cases. Maybe this will eventually show the truth . . . . Sad turn of events just the same.
Be safe.

ok shoot once to disable suspect, shot number 2 was a "to be sure shot" & if he'd walked over and stomped on him they'd be even more upset, crazy world we live in

Truth is always better than fiction. I don't think you could have found a more 'Wild West--Judge Roy Bean' scenerio in any movie script. No doubt the second shot was probably not necessary. :)

I think i will reserve judgement until there are more accounts of the story than just two "bystanders".......in small towns you never know the relationship of the parties involved...I live in a small town where i know probably 90 percent of the people...i know how small town politics work....

I would like to see video or hear from more people. The way it sounds right now, the second shot was not needed.

"It was senseless to shoot him twice."

No joke. From that range, you wold think a trained marksmen could have finished it with one. Haven't these guys seen the price of ammo?

Need more info - the report says he slid to the ground and the officer stood over him, but the witness quote says there was no need to shoot him twice b/c she could have knocked him down. Was he up or down, hard to determine context.

They also use her quote about the defendant's infirmary, but do not use her full quote describing his unruly actions. (Once upon a time, I got a journalism degree)

Language means things - there is a big difference between these statements:

"He swung his crutches around."
and
"He swung his crutches at the judge's head."

Hard to determine if this was a good shoot from the data given - would probably have been better for the LEO if the guy was killed. Definitely better for the guy to still be alive. End result is going to cost tax payers a lot of money regardless.
