Knife laws (VA esp.)

Sorry if this might be a beaten to death topic, or if no one really cares about it, but I'm having some trouble deciphering the knife laws here in VA. I found this, but I am unclear on the a couple things.

In the first section, 18.2-308, which regards personal protection, there is a number of weapons, including specific knives (dirks, switchblades, etc) which are not legal to carry. It makes no mention in this entire section, however, of pocket folding knives.

Another knife law, specific to school grounds, section 18.2-308.1, indicates that folding pocket knives must be no larger than 3".

My main question is that since there is no mention of folding pocket knives under personal protection, does this mean that there is no limit on their length? It seems this way to me anyway.

I'm asking because I really want a spyderco para-military, but it is 3-3/32". I realize that this knife won't be kosher on school grounds, per the law, but it seems that it would be ok for EDC?

(Note that I won't take what you say to be the absolute truth, your opinions are welcome :) ).
 
Easy answer? Nobody, including the LEOs and the courts really knows. You could go to jail if it is decided that your 1in SAK was carried as a "weapon" and might be fine if you had a machete on you way to the woods. Just carry a reasonably sized knife, don't flash it and don't commmit a crime with it(don't commit a crime anyway!) Oh and automatics, balisongs, and anything with a double edge are likely to be called weapons no matter what.

Sorry, I didn't notice there was a specific knife law forum.

I figured it was case specific and vague. I also figured I would have to use my own judgement somewhat. I don't think a folding knife less than 1/8" longer than that which is allowed on school grounds is not unreasonable.

Stay away from the prohibited knives (which, in VA, includes concealed balisongs) and you'll be fine. With the exception of the noted limitation while on school grounds, there's no size limit for folders, concealed or otherwise, in VA state law.

Just remember, even here in VA, where the law specifically allows open carry of a firearm, you never carry your knife for protection or as a weapon.
