im new here in california i just want to ask re:restrictions legal and illegal and stuffs like that... i also want to ask if we can carry knives? please tell me everything you know about knife laws here in california...

To put it simply, you cannot conceal a fixed blade, you cannot carry a switchblade or butterfly if the blade is over 2", and no knives with brass knuckle type handguards. Any size folder can be legally carried and concealed.

Some cities have more restrictive local laws, e.g., Oakland, Sacramento, & Berkeley have 3" limits and in LA you cannot openly carry a knife over 3".

There are also stricter laws for schools and universities.

Do a search in this forum for lots more information. And post here if you have any more questions. I or someone else should be able to answer them.

You can also look up CA Penal Codes directly by going to www.leginfo.ca.gov and clicking on "California Law."

Where in CA are you? What do you carry?

i always travel here in california mostly L.A., Riverside, San Diego and im new in this state, the knives i usally carry,benchmade leopard cub, big spender, mini stryker and stryker. i dont know if these are legal to carry.

i'll be happy to hear for more info about knives here in california

does that mean the limit for CONCEALED carry? In other words, is it ok to carry a normal 3.5" folder, for example, openly in Berkeley (whereas that same folder would be legal in LA only if concealed)?

If so, you really have to stay on your toes when travelling through California!

The 3" limits for Oakland, Sac, & Berkeley are flat limits, don't matter if it's concealed or open. IIRC, at least for Oakland & Berkeley, the law also specifically says that it does apply when you are on your own property. I think this makes all kitchen knives over 3" illegal, though I'm not sure.

FWIW, Fremont has a 2" limit!!

I think the law in LA only forbids open carry of blades over 3", but I'm not positive how it's applied and I recommend that you do your own homework before taking my word for it.

And San Francisco has a law prohibiting carrying a blade over 3" concealed while loitering. So if the blade is not concealed, or under 3", or if you're not loitering, then it doesn't apply.

Confusing as hell, I know. Luckily, though, local (city) laws are only infractions, like speeding tickets are, so you don't get in too much trouble if you do get caught. In addition, most people, and many LEO's, don't know about them. I usually ignore them, and just try to be discrete.
 
Thanks for the great information, Jason. With a 2" limit, it sounds like Fremont is due for a name change. It sounds too much like "Freedom."
 
New Calif statewide law classifies any knife you can open by flicking your wrist is identical to a switchblade.

ps: As to local ordnances, I had no idea! I'll also continue to carry whatever I damn well please. Your local crook, signing off...
 
Small point, but I think our LA City and County laws prohibit open carry of knives of 3" and over, so you'd want something 2.99" or less to be perfectly safe.

I'd be interested in a reference to the law mentioned by Matthew. Do you have a Code Section or any other cite? Thanks a lot.

With regard to penalties, I'm unclear on the infraction issue. In LA, a violation can be charged as a misdemeanor and could get you up to six months in the can (see the text of the statute in the neighboring thread).

Goes to show that you should do your homework before trying to help someone out by giving what you believe to be good information, and you damn well better do all your homework before carrying anything anywhere. I do my best to help educate people about CA law because I don't want to see my fellow knife knuts in jail, but you (that means all of you) should double check anything that I, an LEO, or anyone else says before you act on it. State and city laws are readily available online from official sources, and you should always check with them. Don't believe what some anonymous person on the internet tells you, look it up yourself, that's what I did.
 
Thanks very much for the reference in the neighboring thread. All my folding carry knives have detents/closing bias, so I should be OK.
 
so you're saying that just having a blade greater than three inches on your PROPERTY is a violation of city law? it's bad enough that this city treats the students of the university as second class citizens and screws them mercilessly... now i see that the vegans and hippies sellings bumper stickers have completely taken over the city. just glad i'm moving out in three months.
