New York State: Balis and Autos

Hello,

I am wondering about two types of blades: BaliSong and OTF Automatics:
-Are they legal in NY state? to own, to carry?
-can they be shipped? in state, interstate?

this is my understanding....not 100% sure

balisongs are legal to carry and own in NY
you cannot carry a balisong in NYC (this includes Queens, Brooklyn...etc)
They can be shipped to New York. Shipping to other states varies on the states law to which you are sending it to.
 
As for the automatics, I am certain they are completely illegal with exception of miltary/PO/EMT. Not ceratin about emt's however.

As for shipping, where there is a will theres a way. I suggest speaking with forum members VIA E-MAIL on that subject, as it is a federal offense if not done properly.

NYS Penal Law and Criminal Proceedure law: 265.20 6. Exemtions.Possession of a switchblade or gravity knife for use while hunting,trapping or fishing by a person carrying a valid license issued to him pursuant to section 11-0713 of the environmental conservation law. If you wish to get more info go to your Public Library, in the referance section you can look up the above Law book

EMT LEO'S FIREMAN are all civilian's - civil servant's all. They are all bound by civil Law.The Military have thier own Law's .They can call us civilian's.
 
can you find me a specific law that says balis are legal to carry in NY? obviously outside of NYC. My dad is a police officer and took mine away; says ill get in trouble. Prove to me that i wont? heh.

NOTE this applies to the state and monroe county, your particular municipality my have other ordinences in addition to the state law.
 
In both NYS and NYC you may carry an auto or gravity knife while fishing, hunting or trapping with a valid license to do so. The NYC Admin Code and NYS penal law both have this exemption listed. Butterfly knives were treated as gravity knives for a long time ( and still are listed as such by NYC PD in the patrolman's guide) but a court case determined them not to be gravity knives solely because they did not automaticaly lock open, and therefore did not meet all the requirements of a gravity knife. As for the new spring assisted openers, they also seem to be legal since the switchblade definition states "pressure applied to a button or lever in the HANDLE of the knife" , since most if not all spring assisted knives require pressure to be applied to the blade via a stud or other means, they seem to be legal at the moment. I strongly suggest carrying a simple hook and ten feet of fishing line in a small compartment of your wallet. This is legally "fishing equipment" . It does work.

"Switchblade knife" means any knife which has a blade which opens
automatically by hand pressure applied to a button, spring or other
device in the handle of the knife.
