Advice?

Ok, I need some advice. Today on the way to work, some guy hit the rear end of my truck. My insurance gave me two options. The first being to call his insurance company (AAA) and file a claim with them and have them pay for everything. The second, file a claim with my company (Allstate), pay a modest deductable which I'll most likely get back anyway, have Allstate front the money and go after his company. Now I don't know much about these things, but if I go through my company, even though the accident was not my fault, is that bad? Will my company be more willing to work with me (spend money doing the job right) based on the fact that they will collect all the money back from his company? Will his company be less willing to spend money (less likely to say my frame is bent or use less than factory parts). Anyway, do you think I should use my company or do I go through his? Sorry for the crappy question, but you all seem fairly reasonable and maybe some of you know about this type of thing. My big concern is that my frame might be bent and his company won't be as willing to admit it because they would have to pay for it, but if I go through my company it might make my rates go up. The accident was not my fault and that's pretty clear, so is me worrying about my rates a real concern?

I can't claim much knowledge on these kind of things, but I can tell you that Allstate is a total suck a$$ company to deal with. They screwed me royally and I had to leave them. Try not to involve Allstate as much as you can, and get somebody better. I ended up getting my insurance through a small company that has taken great care of my entire inlaw family. Can't quite dredge up their name right now though.

I'm sorry about the aggravation you're going through. Don't let it rattle you, though. Treat it as straight business.

Unfortunately I have been down this road. Once I was rear ended by someone with insurance from my company ;)

Another time I was rear ended by someone with Allstate. They treated me very poorly to the point it nearly went to court. This just to get my expenses reimbursed for medical bills and a pitance for the lost time from work. If I had not been laid up so bad and afraid of losing my job pursuing the matter, it probably would have gone to court. My back has never been the same but, I did get me sense of taste back :eek:

Last time, a police officer on duty rear ended me. The city was self insured so it was a real joy for me to deal with that mess. In the end I lost about $3K on the deal because I couldn't afford the time to sue. My insurance company fixed my pickup and eventually got my deductible back from the city. If fact when I got the check, I had to ask them what it was for since it was so far back.

Be thankful if you suffer no medical problems. Cars can be replaced, health cannot be recovered in many cases.......
 
Always Go through the other persons Insurance Company if liability issues are not in debate.Never use yours as your insurer will make you pay as they then must put in force an adjuster,claims,underwriter etc etc and then collect from the other guys insurance.Simply call the other guys carrier,state your case simply then suggest they take care of it before you get attorneys involved...hahahaha...watch them fly to take care of you.above all..be friendly,act cool yet professional and the other guys carrier will take care of you faster then your insurer will. Why? Many reasons....just trust me on this one as it would take a day to explain in detail insurance claims and subrogation issues.
