Another case of copyrite infringement?

ya, im lookin for what those knives look like, and im not really finding anything. they have elements of shane siberts knives (the single small fuller), as well as elements of simonichs knives (the handles)

but overall i think they do an allright job of holding up on there own. if you mean the talon hole, i think thats probably why he put double holes there
 
I think the differences are enough to avoid any infringement, but I am not Jerry or his legal representative.

There's so many model of fighters out there I have to disagree with. No I don't think the holes should be there, but there's a LOT of fighters out there!
 
I don't think it counts since there are two holes. Copyrighting can get crazy, I remember a few years ago Metallica tried to say that they had copyrighted a chord :rolleyes:
 
i actually come across knives pretty regularly with the holes, im not really sure how much jerry cares.
 
There's a lot of styling there, Harsey, Strider, Sibert, SOG, Snody, Tarani, and of course the TAD guys and Munroe... but you also see where they took pains to move stuff around in order to not infringe on any one maker's style. I don't see any infringement at all in the end product.
 
Oh yeah, those knives wouldn't be as good without the holes. They are vital for a lot of things, such as lashing to poles for a spear, or putting a cord loop on the butt for better control when chopping...
Since they have to be there, I think they did a good job of coming up with a design that can't be directly attributed to someone else.
 
If you guys are going to try to cry copywrite infringment then Busse infringed first by putting a hole in the rear of the handle, and again by using micarta as a handle material! Give me a break you guys. You are really really grasping at straws on this one.:rolleyes:
 
Is a hole in the pommel a registered trademark? Or micarta scales?

Well no... that's kind of the point. They are no more or less copywrited than putting a hole in the guard. Right? Please don't tell me Busse somehow managed to get that "idea" copywrited.
 
theres a huge difference between a registered trademark and a copyright. In the case of the "talon hole" yes, it is a registered trademark of Busse Combat. Its not simply and idea. One problem with a trade marked image or item is its hard to make a company from overseas stop what they are cloning. Theres so many Chinese made clone knives out there that blatantly break every trademark and copyright, but its next to impossible to enforce it.

In the case of my artwork, I hold a copyright on each and every one, and its dated to prove time of completion. One does not have to register a copyright, its much harder to defend as well. In a court of law, if I can prove that I produced a particular piece before a person that produced a very similar peice, I can effectively keep him from selling that piece.

a third form of ownership is a patent, and a whole different can o worms there that I dont think applies here.

In some of my graduate studies in Fine Art copyright infringement was discussed in greath depth, its all too easy to find yourself on the wrong end of a summons these days. You must know the law and what you can and cant do, even basing a painting on someones photograph is an infringement.

As Dwayne said, it is indeed a registered trademark. it is not copyrighted.

I don't need to call the shop to know that calling a drilled hole in a piece of steel original is retarded. I'ma busse customer and love their knives but I gotta say this is ridiculus. When another company starts using a steel and calling it "infi" they'll have a case.
