I recently totalled my truck, and my insurance is being a PITA:mad: I just bought the truck 2 months ago, and didn't get GAP (BB is $27k, NADA is $24k,) I owe 23,, and ins. wants to only pay 20k. However, I'm licensed and insured in Utah, wrecked in N. Dakota, and it's the ND office that's handling my claim? While they're comparing prices supposedly from my area, they are subtracting out about $1500 of each price for supposed sale price, and using private party prices from autotrader to lower the value of my vehicle. They also aren't making adjustments for some of the higher priced options on my truck (FX4 package, upgraded wheels, backup sensors) which added $1200 to my truck on KBB and NADA on trade-in price.

First, shouldn't a Utah office be handling my claim? Ins. laws differ state-to-state, and I'm wondering if the ND laws are more company oriented than individual oriented. Also, while I don't expect to get KBB price;), shouldn't an appraisal of my truck more accurately reflect its value than a list of recently listed trucks that, while the same basic vehicle, vary greatly in price and options, and are not available to check out and appraise? And, how can I work with my insurance to get the best value for my truck?

Thanks for any help!

With a few thousands dollars at stake, you would be well-advised to spend a few hundred dollars to have an attorney review the situation for you:

It is very common for them to attempt to defraud you on the value of your vehicle. I've been in your situation. It's their policy. Call a lawyer tomorrow morning. Make the insurance company pay him, too.

Also call your state insurance commissioner, and explain what is going on. They will know where your claim needs to be handled; the state you live, or the state you wrecked in.
