Are balisongs and AOs legal in PA?

Ive heard that balisongs are legal to own (correct me if im wrong) in Pennsylvania, but im not sure about carrying. i really only want one to play with and to try it out, but if i forget its in my pocket that might be a problem.

Secondly, im confused if the last case law below means that Assisted openers are legal or not.

heres is a the laws i found

Pennsylvania - Pa. C.S.A. 18.908. Prohibited offensive
weapons. (a) Offense defined.--A person commits a
misdemeanor of the first degree if, except as authorized
by law, he makes, repairs, sells, or otherwise deals in,
uses, or possesses any offensive weapon. (b) Exception.--
It is a defense under this section for the defendant to
prove by a preponderance of evidence that he possessed of
dealt with the weapon solely as a curio or in a dramatic
performance, or that he possessed it briefly in
consequence of having found it or taken it from an
aggressor, or under circumstances similarly negativing any
intent or likelihood that the would be used unlawfully.
(c) Definition.--As used in this section "offensive
weapon" means... any... dagger, knife, razor or cutting
instrument, the blade of which is exposed in an automatic
way by switch, push-button, spring mechanism, or
otherwise...

Pennsylvania case law:
Where opening knife required lock to be released, and
once lock was released blade could be exposed by flip of
wrist, knife did not have blade which could be "exposed in
an automatic way"... by "otherwise" legislature referred
to knives that were opened by some sort of mechanism which
is not a "switch," "push-button," or "spring" mechanism
but still a mechanism... (1979)
 
Commonwealth v. Miles established that balisongs are legal in PA both to own and carry. Now, I will tell you that I did hear from a person up there who had his balisong confiscated by an police officer (no arrest or citation), but other LEOs I have talked to have indicated this would technically have been an illegal seizure. Just warning you though.

As for AOs, really hard to say based on that language. That case law quote seems to refer to balisongs and folders that can be "flipped" by inertia rather than AOs. Right now, my superficial interpretation is that AOs would not be allowed, to err on the side of caution. But will defer to others on this forum who might have a better reference.
 
Yes they are. There are some exceptions (Philly being one) where pretty much any knife could be considered a weapon and can get you dinged.

Only auto's are illegal to carry in Pa. You can own auto's as a collector but you need to leave them at home.
 
ok thanks. i guess i can ask some of the officers at one of the local police barracks' about the assisted openers. till then ill just play it safe and hold off on them.

Assisted openers are LEGAL to carry in Pa.....it is that simple. I've talked to many Pa. law enforcement officers and they don't always know the law. I've had them tell me the knife isn't legal if it is wider than the palm of your hand. Obviously untrue. Only autos are illegal to carry.
 
I can corroborate LEOs not knowing their own law. Over here in MD our laws are not even as ambiguous and we had a LEO lose his badge for a bad arrest on knife carry related charge. I generally like LEOs and it's probably uncommon, but it happens. Russian Roulette only takes one bullet, know what I'm saying?

Perhaps a more pertinent question to ask oneself may be "What do I plan on perpetrating wherein the police will see my knife in the first place?"

Well first off i do some maintenance work at a nearby barracks every now and then and i use my knife often. Secondly i plan to be an officer so i cannot risk losing my career path for something stupid.

Don't do something stupid and carry an auto and you'll be fine. :D
