Are you paying sales tax on mail order out of state purchases?

how many of you have mail ordered from Marking Methods (or for that matter any other company) and you do not live in their State of business and
have paid them sales tax on the order? if so read below.
mind you
I'm not targeting this one company but I do know many of you use them and I can't be the only one they have wrongfully charged Sales Tax to.


this is what I got back after they charged me state sales tax
and I brought to their attention..almost a month ago.

this was about a month ago with no credit back as of yet:rolleyes:
I did ask for it to be charged back to my card..

I'm sure it could have been an oversight also..
.BUT because of the time that has gone by with no credit.
I'm sure I'll get it after the e-mail I wrote them this morning it's one they will not like me to pull through on..because I can have the card charged back but it will have to be for the full amount and then they will have a slight mess on their hands..of course first I will contact them by phone
but where as they did get back to me by e-mail and where they do not have an 800# I'll do it by e-mail first.

I wouldn't have even said anything if they did what they said they would do in the first place..
But to chase $7.06 around just for the principle of it pisses me off to say the least ,,if it were just this one time with just this one company that I've had problems like this with I won't blink an eye about it
but collectively it adds up and is still wrong..and the Blood pressure adds up too. ..

this is just a heads up for those of you that don't know it..

if you buy taxable product from out of state and the product is mailed to you, and the company does not have an office, warehouse or sales department in your State in most cases you do not have to pay their State sales tax..
But check to see if your state has a use tax set in place,
if they do and is the case your
state will want what is do them for any out of state purchases.:(

if the company does have an office, warehouse or sales department in your State they will charge you the sales tax and pay it for you..you pay no Use tax. just some food for thought...
 
In Illinois, they've got a form one is supposed to fill out and use to submit sales tax for all the items purchased out of state! :jerkit: We're supposed to pay IL sales tax on out-of-state purchases, too. The only states excluded are those bordering states where there is a reciprocity law. Imagine that! I bet they have a whole department of bureaucrats to process the two forms they get from some idiots actually following the law every year. :rolleyes:

Charging state sales tax when it's not necessary has been a scam for many years in the mailorder game. It's a sleazy bean counter's way of increasing profits. They promise reimbursement then drag their feet hoping you'll go away. It's hard to report them to your home state because then they want you to pay regardless. Wonderful system......

it's called here a use tax form and it's in our tax returns paper work.
I was tied up with Amway at one time an the only way the state would let us buy product from Amway for resale was if we all paid sales tax, even though I had / have a resale exempt certificate but that didn't matter in this case,,

little that most anyone knows when the product was resold we all can/could submit a form at the end of the year to get those taxes back.
can you imagine the state going out of it's way to let everyone know this:rolleyes: can you imagine the moneys the states have collected from Amway members and not paid out just because the people don't know this,
talk about double taxation and taxes on taxes..
the higher ups in Amway all through the lines did not even know this,, what a bumbling bunch :jerkit:

That's good to know, Dan. As far as Illinois, they still owe me several hundred dollars for an income tax return years ago. #***^# state never did pay, even when I went through the channels. Now, I won't spend a damn cent in that state.

interesting, thank you, that reinforces what I wrote..
that mainly pertains to instate entity not out of state sales by mail through the internet..
any item I sell in state, be it out the door or by mail via the phone or internet I collect sales tax..
based on the entity term..
but the way that reads I'm not sure I should be collecting in state if the order is from the net and with-in my state.. I believe the State of Maine says yes I have to..
 
No and I would not. So far I have not had any nasty suprises like that but should I it will not happen again. I am sure the burn will eventually come but after that one I don't have to order from such sender again. We are taxed WAY TOO much and have been for a long-long time. Nasty little games costing me 5, 6, 7 percent extra ain't going to work on me more than just once.

As you might suspect, I am a "small government" conservative.

Glad you got the credit you deserved, Dan.

I wrote a lot of code for a former employer who did internet sales of medical and pharmaceutical equipment that handled tax calculations. Only if you have nexus (basically an office or any place of business) in a state do you need to pay sales tax for purchases made from that state. The same goes for city, county, parish, etc.

But there will be a time it will change but as of right now there are too many
tax differences in their codes from State to State for the Gov to deal with. till then :D
so it has to be at state and Distributor level. It's coming though
