Automatic Shirogorov

So I bought a shirogorov from a US dealer and it was classified as an automatic at Canadian customs. As far as I know the 95 nudist models do not come in the automatic variety. I have 90 days to appeal the decision and would greatly appreciate any help on the issue. It's just a flipper, an unassisted flipper in fact.

The seller also shook it as hard as he could to try to deploy the blade with no effect.
 
I noticed another thread here in the knife laws category claiming that assisted knives are on the way out in Canada as well. Has anybody had any luck with appeals on these decisions? There's been no change to the knife laws in Canada, how do they just up and decide to label something as a prohibited item when they are sold all across the country?
 
Not sure how you will go on it, since it doesn't seem to be a case of one officer doing their own thing. You can try to appeal based on the letter of the legislation, but I think that precedent is against you (although I'm not a lawyer and have not been following this closely). CBSA can play by their own rules, the knife would be legal if you got it, but they can decide that its not legal to pass it along. Strange but true.
 
I looks like I have a pretty strong argument here, not only does my knife not operate by a button or lever attached to the handle, it also does not contain a spring or mechanism.

Thanks for the reply, I'm not really sure what I'm looking for with this thread, basically just a heads up that this is what's happening up here in Canada, and if anyone has been successful with getting their knife back I'd like to hear how.
 
I don't know what the consequences are if you try and fail, so I'd seek some council on that. But it may be worth a shot.
