Axis Lock = Gravity Knife?

I never use the thumb hole on my afck, however, the afck falls into legal folder in california because of the thumb hole on the blade. So, if I claim that I use the hole to open, then I cant be arrested for having a gravity knife, correct? :D

An AFCK is not a gravity knife for purposes of California law, assuming that it "has a detent or other mechanism that provides resistance that must be overcome in opening the blade, or that biases the blade back toward its closed position."
