BenchMade Skirmish

Has anyone had any legal problems with the BenchMade Skirmish? I have one and it can be opened by flipping without touching the blade. Sometimes it may take 3 or 4 flips but it can be done. I have tried tightening the screw but either it is too tight to open easily or it can be flipped open. As far as I am concerned it is no big deal as I can open my waved Emerson Commander faster and easier than flipping the Skirmish. However, the Emerson is legal and the Skirmish could be questionable. Anyone had any legal experiences with the Skirmish or any opinions?

If the pivot is loose enough which isn't hard, it becomes a gravity knife. However in all practicality, the size would cause more of a legal 'skirmish' than anything else.

The size is legal here in Texas. Up to 5 1/2 inches is legal here.
