How do I find out if my state limits the length of blade I can carry. I live in NM. Thanks
 
New Mexico - Criminal Offenses - 30-1-12. Definitions...
B. "deadly weapon" means any... weapon which is capable of
producing death or great bodily harm, including but not
restricted to any types of daggers, brass knuckles,
switchblade knives, bowie knives, poniards, butcher
knives, dirk knives and all such weapons with which
dangerous cuts can be given, or with which dangerous
thrusts can be inflicted, including swordcanes, and any
kind of sharp pointed canes...
- 30-7-2. Unlawful carrying of a deadly weapon... consists of
carrying a concealed... deadly weapon anywhere, except in
the following cases [own residence or property; private
automobile or other means of conveyance; official]... a
petty misdemeanor.
- 30-7-8. Unlawful possession of switchblades consists of any
person, either manufacturing, causing to be manufactured,
possessing, displaying, offering, selling, lending, giving
away or purchasing any knife which has a blade which opens
automatically by hand pressure applied to a button, spring
or other device in the handle of the knife, or any knife
having a blade which opens or falls or is ejected into
position by the force of gravity or by any outward or
centrifugal thrust or movement. Whoever commits unlawful
possession of switchblades is guilty of a misdemeanor.

New Mexico Case Law:
- "Jury to determine character of weapon..." (1973)
- "...a butterfly knife was a switchblade..." (1991)

Does this mean I can keep a loaded gun in my car, any kind of knife I can legally own at home (ie I'm military, can I keep my auto in my car?), etc. I've had various friends interpret the "private auto" part in various ways....

based on this section, it would seem carrying in your car is legal. keep in mind this is the state section, cities will have their own municipal codes, so check local laws as well.

also, if stopped by police for any reason, it would be a good idea to let them know you have a weapon in the car. they may or may not ask, but tell them, helps build trust.
 
Do not even HINT that the knife in your car is a 'weapon'. This has been discussed in several threads here.
 
I have to agree, that you may want to say you have a pocket knife not a weapon, and I would not even offer that unless it is on your person, or in clear view and within reach of you. If not, then why bring up the issue? Traffic stops are all about a motor vehicle infraction, not a penal law violation. If you tell an officer you have a weapon you are providing more information than needed, and if he ask if you have a weapon then he is already fishing for more than the traffic stop and a ticket.

who said anything about a pocket knife?

the answer i provided was for firearms.

vehicle stops are not always for a vehicle code violation.
 
knife forum so I assumed knife, but I would agree with your statement for a legally owned firearm. I stated traffic infraction as if there was another reason for the stop then a search maybe warranted and the nature of the stop would be different......In NYC the interest was VTL enforcement so less talk was the norm.

I don't agree with this - - if stopped for a routine matter (common traffic violation, tailight out, etc) you may very well just get a warning or a ticket and be on your way. Be respectful, as you would want to be treated. - - If asked to step out of the vehicle, that is another matter. Been there, done that when some skumbag stole my license plates and switched them with a vehicle that he stole. - - - The matter was quickly resolved and I got my gear back from the officer(s) - there were several more there before everything was cleared up - - no problem. - - [ If your state or municipality may have a different requirement in terms of notification - - check out the laws.] Best regards, - -
 
what is the legal blade length to carry in New York..suffolk county folding and fixed blade?? what about NYC?? Thanx, Also do you need a dealer license to sell knives in NY?
 
what is the legal carry length of a knife blade in New York, Suffolk Co., Nassau, City, that would be of the fold up design as well as a fixed blade design. thanx.
 
johnnd, this has been covered many times here and a search will give you the answer, but in short NYC must be under 4" and concealled, the rest of NY State has no size limit. No switchblades or gravity knives unless fishing, hunting or trapping with license.

i was talking about a firearm, not a knife. quoted out of context yet again.
