I don't know where else to post this. I hope this works. I am going to be flyng to Boston with a declared pistol that I am going to be giving to my son. I have noticed in some cities if you show up with a gun in your bag you are subject to arrest ie: New York Chicago etc.. Can any of you folks in Boston help me out with some answers?

umm....

don't do it.

unless you are strictly traveling through MA, you can't be in possession of a firearm without a license/permit. and from my understanding, "traveling through" may get misinterpreted in the great commonwealth of massachusetts.

when you arrive at logan, your checked firearms arrive on the conveyor belt just like any other checked luggage. so it's not like you show up there any everyone knows a firearm is in your suitcase. but it is largely construed as illegal, so don't do it.

do things the right way. i'm pretty sure that means FFL from your home state to an FFL in MA, and with your (licensed) son picking it up from there.

PS when i mean "traveling through MA" i mean like, driving across state lines. since you're flying in, that's a no-go.

If it's a high capacity magazine pistol, be careful as well. I think it was Logan (BOS) where a guy had his connecting flight canceled and was arrested for a high capacity magazine he had with his declared pistol.

The Boston Globe has published TSA statements declaring that those arriving without a MASSACHUSETTS LTC will be arrested. Unfortunately, MA does not recognize any other state's Licenses, so you are not legal to carry a handgun here--boxed and locked or not. Arriving in Boston's Logan Airport does not meet the "traveling through" clause of the Federal "Safe Passage Act".

As mentioned, the safest way is to transfer FFL to FFL.

One other option, providing your son has a LTC-A, is to have him bring the gun in state himself the next time he visits you.

Or, fly to a nearby gun friendlier state and have him pick you up there and transport the gun into MA under his own license. As mentioned, make sure you don't bring any normal capacity magazines (more than 10 rounds unless grandfathered and you have receipt), and no modern sporting rifles with collapsible stocks.

Another option, just because I'm thinking creatively. I would not try this without a signed letter from a lawyer AND from the Boston Chief of Police or TSA authority. You are legal to declare the handgun in KS. Your son, assuming he has a LTC-A is legal to retrieve it in Boston. You could pursue the course where you check the luggage and your son retrieves it so it is never in your possession in Boston. Although I think the point of breaking the law and arrest is in retrieving the luggage with a firearm, I would NOT try this without getting the above mentioned documentation.

many thanks to you guys. I on my way to visit my kids and grandkids not jail. Sure do appreciate the help.

Any chance of them moving closer to you? :)

On a related note, I turned down jobs in that part of the country in the past even though the pay was VERY good for reasons like this.

No, no chance of that. In Kansas it would be no problem. Here is the motto for Massachusetts. "By the sword we seek peace, but peace only under liberty"
