Butterfly knives, legal in NY state.

I just found this out and thought I'd share it.

New York Case Law:
- Knife... was not a "gravity knife"... even though blade of knife could be released from its sheath by flick of the wrist; in order to lock blade of knife in open position, two additional steps were required... (1989).
- Butterfly or "Balisong" knife, a folding knife with a split handle, did not have blade released by force of gravity or application of centrifugal force, and did not constitute a "gravity knife"... (1987).

Looks like they are OK in NY state.

Remember just cause it's legal doesn't mean your not going to get arrested for it. Most police if you ask will say that it's illegal and that only covers the state. NYC has it's own set of laws as do most of the counties.

As for Auto's they are expressedly illegal in NYC and many counties, but not all

"pursuant to Penal Law Section 265.20(a)(6), if you are "hunting, trapping or fishing," you may possess a switchblade as long as you are in possession of a valid license."

While case law may not classify them as "gravity knives" (and hence illegial in NY), the New York AG's office DOES consider them illegal, at least in the opinion of one shopkeeper in Central New York.

A year or two ago I stopped into this little Army-Navy surplus store that carries knives. They used to carry balisongs, but their case was devoid of them when I stopped in. I asked why, and was told that under Vacco (who has since been replaced by Democrat Elliot Spitzer) the AG's office contacted them and told the store's owners that balisongs WERE considered gravity knives (at least as far as Vacco's office was concerned), and that they could no longer legally sell them. The store was forced to "eat" its stock of the knives.

While I have no outside confirmation of this, and no idea if stores other than the one I visited were contacted, it makes me suspicious that perhaps balisongs are NOT legal in NY, or might be considered illegal in the future.
