I just realized somehting.. the knife show is coming up next week right.. so ofcourse I woudl like to bring a knife for Mr. Elishewitz to sign. Now here's the kicker... I have never been to a knife convention before and in New York no less.

Hypothetically won't it be trouble if you buy or carry or bring an illegal knife into the NYC knife show? I mean you'd be easy pickings for a 'search', won't you? or is there a special policy with knife shows?

Shoudl I stay cautious and carry only legel blades (whatever they are) thanks for the help.

sniperboy,

If it is an Elishewitz piece then it is ART and New Yorker's (and their courts)seem reluctant to interfere with artistic expression

. I'm not a lawyer and I don't live in NY so my advice may be worth what you paid for it. All the best, Alan

Disclaimer: I am not a lawyer nor do I give legal advice.

NYC has its own Administrative Codes and Rules and Regulations for what constitutes a violation of legal length and type of knife one possesses. Article 265 of NY State Penal Law, which is applicable in NYC, deems "Butterflys, daggers(double edged), Cane swords, Pillum Ballistic knives, switchbaldes", etc. to be illegal to possess. At NYC Police headquarters at 1 Police Plaza, near the metal detector entrance there is a conspicuously displayed sign that reads; "Possession of a knife with a blade length of greater than 4" is grounds for arrest". Seems pretty clear. But then most households seem to have quite a few large kitchen knives.

At the past Novenber East Coast Custom Knife Show in NYC there was a readily displayed sign near the show entrance that read something to the effect of: Possession of knives with blade length of greater than 4" on their person is not permitted. Sounds like a pre emptive to possible lawsuits in case of injury of any type! The key words is "on their person". So it may be good advice not to pull your hardware out of your pockets or waistband in a wild fashion.

Hope this clears things up a bit. Fellow forumite Boriqua had a thread with some helpful links from the District Attourneys office which is probably the best source for rulings. Try a search.

PS- look at all the display tables at the show. What blade lengths do you see?

Weapons laws generally involve some aspect of intent. If you carry the knife in such a way that it is very clear that you do not intend to use it as a weapon and that you do not even think of it as a weapon, then it's generally no problem.

I'd suggest wrapping it in a cloth or putting it into a pouch of some sort (not a sheath), putting that bundle into some sort of a closed box, and then maybe even putting that inside of some sort of carry bag, brief case, etc. An "off body" carry inside a closed bag or brief case only adds to the "this is not a weapon" appearance.

Treat the knife and carry it like a valuable, collectible piece of art and police officers and, if necessary, courts will be much more likely to see the knife as a valuable, collectible piece of art that you have no intention of using as a weapon.

By the way, you can get very nice, soft flannel pouches at better jewelers. Look for one that sells fine flatware because this is what those pouches are sold for. They generally cost a couple of bucks.

I dont remember ever being searched at any of the NY shows. Now Im not saying it cant happen but I went home with a steel heart in my jacket pocket from the last one adn I never go anywhere without my sebenza in my pocket. Once your in the door there is so much cutlery floating around that I doubt very much your knife will raise an eyebrow hair much less an eyebrow.Disclaimer: Now this has been my experience at past shows and not nessesarily the way it will be. I have been going for years now and that has been my experience. At my home page under "news and views" is what I believe to be pretty comprehensive info on NY knife laws.

The sign at the last NYCKS said something to the order of..
"Knives over 4" must be carried in a manner that is not readily accessable"
(Not a verbatim quote, but you get the idea, right?)
Gollnick hit it on the head, wrap it in a box and put it in your backpack and you should be OK. "Readily accessable" is the key phrase...
Having said that, I am not a lawyer and I didn't write the rules.
You could call the # for the show, they might be able to help...
See ya there!

THanks guys..

I guess it is time for all men to face their destiny. Pack our bags, leave our troubles and woes behind- once we leave our homes we will be immersed in a world of bliss, even for a moment... just a moment..
