Citizens catch cop speeding face arrest?

So, dear readers, how exactly does an immobile, stationary camera go about stalking someone, hmm?

Hmmm, indeed.

I always wondered where the law fell on that one...can cops go as fast as they want without lights or sirens on....which unless I'm mistaken are there at least in part, to warn other cars that a speeding police car is coming and to make way---to warn us?

So if they fly around (which they DO here) without lights/sirens is that legal?

Interesting question. I guess IF they are responding to a distress call and they don't want to have the bad guys know they are coming, but still they could run their "Blue Light Special."

I know that if you are driving along and run into an emergency vehicle, or one runs into you because you did not "yield," you can be ticketed.

But I have seen cops speeding for no apparent reason. I also have seen cops trying to pull out into traffic, turn on their lights to stop all traffic, pull out and turn them off again. So, he got tired of waiting. SO?

Now in the thread I started it was never said that the cop was trying to respond to an emergency. This would be a helluva defense. It was NOT used, so I assume he was just speeding.

I think his response to trying to charge the citizen with stalking is a flagrant misuse of the law and the cop should be sanctioned. :foot:

Even if he was on an "emergency silent call" this is idiotic. Not only that, but a battle that I do not see he can win.

I try never to start battles I have no hope of winning. Just makes you look stupid.
 
Police Officers are required to obey the traffic laws of the Vehicle Code, in California. Officers are exempt from obeying the vehicle code while operating an emergency vehicle with lights and siren, but are required to use diligence and not operate the vehicle in an unsafe manner. Officers can be held punitively responsible for accidents/injury that results even under emergency operation
 
This thread reminds me of an episode on "Mayberry" where Goober was pulled over by Barney Fife for some very minor traffic infraction.

Later Goober saw Barney make a U-Turn right in front of City Hall to park his police car in front of the police station.

He chased Barney into the police station screaming "Citizen's Arrest!"

Barney was furious and Andy had to straighten that one out.

I very much support our police as well as our military, but I do want them held to standards, especially whe there is no emergency.

They should always be models of the Law.

In Georgia, the police used to get very close behind a car being driven by a violator. Very close! Then they would hit the lights and sirens and scare the cr*p out of the driver.

This changed when cop friend of mine did this -- the driver panicked and hit the brakes. My friend cop, on a motorcycle, ran into the back of the car and broke his wrist.

He wrote a ticket to himself for follwing too closely. Also the police changed this procedure.
 
years ago nys troopers were caught speeding numerous times on camera -
not just a few mph over either-there was a big stink on tv about it
 
In all states of Australia the police have to obey the rules of the road. There are rules for pursuit of offenders. There has been a number of well publicised deaths of innocent bystanders during police pursuit of traffic offenders recently. This may further restrict the rules of pursuit after full and proper examination of the circumstances.

A number of police have been caught speeding, in their police cars, by speed cameras and red light cameras. They are treated in the same way as any other citizen.
