concealed in plain view?

like the title? i thought it was clever. anyway. anybody who has ever read the knife laws in NJ knows that they are, at best, a rough layout, and are mostly about buying and selling, not carrying. i never leave the house without a knife, unless i'm going to a federal building or school or some such thing. now, in the fall or chilly spring (like right now), i wear a duster that is longer than yer average coat/jacket. i've often wondered, if my coat covers my knife, even though it is otherwise in plain view, is that concealed carry? the knife rides a clip on my right front pocket. i'll include photos of the coat and the knife on my pocket without it. the disguise is for the benefit of the viewer, trust me.:cool: :barf:

if it is in your pocket, it is not in plain view to begin with. covering it with your coat becomes incidental.

concealed normally means hidden from view, in part or all.
 
how should i carry it, then, if not on my pocket?

does your state prohibit ANY concealed carry, even for folders? if so, then you are sol.

your missing the point, i was just stating that concealed means any or all is hidden from view. open carry means the whole knife/sheath is visible.



btw, i just read the nj laws, and dont see anything prohibiting concealed carry.
 
that's what i mean, they DON'T specify, but if someone happens to get into trouble, and the knife is say, in a deep pocket, the cop can and sometimes will write 'carrying a concealed weapon'. i like to have fast access to my knives, which is why i carry them the way i do. but if it means avoiding an infraction, do you think a belt sheath is the way to go?

carrying concealed might be an aggravating factor, though i see nothing that would indicate this. nor anything that would make it a crime in and of itself.

a belt sheath may be safer as far as what you describe, but i see no problem with carrying it clipped in your pocket.

also consider, you would likely have to be arrested for something else, ie crime against a person, to have the knife be any factor at all.

eg: someone is arrested for a battery on their neighbor. a search of the person incident to arrest yields a folding knife in the mans pocket. the knife might be booked as evidence to indicate the man was also armed when he committed the battery. thus an aggravating factor, though not necessarily a separate charge.

or, you are arrested for trespassing. you are searched incident to arrest and a folding knife is recovered from your pocket. the knife has nothing to do with your arrest, it is simply in your pocket. you are given a ticket for trespassing and sent on your way with your perfectly legal knife. there would be no reason to indicate you were carrying it on any report.
