Concealed knife question.

I'm curious if a folders clip and say 3/4 of an inch of the handle is visible is it considered concealed? LEO responses welcomed and appreciated.

The answer will vary from state to state.

In Oregon, the knife is not concealed if any portion of it is visible. A clip hanging over the lip of your pocket is all it takes.

Here's a California case from my collection of such things (Is this a dagger which I see before me?) where a partially visible dirk or dagger was found to be "concealed."

People v. Fuentes

This was not a solid citizen walking around with a knife for honest and non-violent cutting chores. This was a bad guy whom the cop had interrupted in the middle of a robbery, and the concealed weapon charge wasn't his only problem.

I have wondered about this also, because if it was true then I could carry over a 3 inch bladed knife around as long as the clip was visible. However I am not very confident in the local LEOs ability to interpret the concealed weapons laws. I think I will email them and see what they say.
 
Like most of the weapon laws worldwide it seldom makes much difference what you're carrying or how you're carrying it. In practice those laws are basically not about carrying a knife, they are about such things as being of the wrong race or ethnicity, the wrong age, wearing the wrong clothes, being in the wrong place at the wrong time, having a previous criminal record (often for one of the above rather than committing a real crime), acting guilty or sassy instead of confident when a cop interviews you ...

That's why the laws are written so vaguely, so as not to let issues of what you're carrying or how you're carrying it interfere with the real reason for the law. Asking for clarification is not going to get you anywhere; the fascists do not want to clarify. They won't tell you how blade length is measured or what concealed or open carry means -- they won't tell anybody, so we can't tell you either.

The defense "If it was concealed how did you know it was there?" ought to be an automatic winner ... and "How many of you jury members do the same thing or have friends and relations who do?" "Joe Blow got tried for the same thing two years ago and he was aquitted," too. Things ain't always what they ought to be.

JakeP, I think Cougar Allen told you the truth. As a minority knife enthusiast, I am extra careful about what knife I carry and where I carry it. For example, I would never carry a large tactical like a Military or AFCK in a large urban area. Cops there would take it to be a sign of criminality. A smaller knife wouldn't necesarily be seen positively but if youare within the law you should come out alright.
 
I've been a cop ten years. I personally don't care what people carry as a pocket knife. Florida law basically says you can't carry a dirk or dagger or a knife (pocket) as a weapon. The law is vague for the reason of leaving it up to how the officer sees it. That could be both good and bad. For me it depends how and why the knife is being carried, as to whether or not it a weapon. Yeah I know its a play on words.
