Copyright / Trademark Question

Question for Sal, Eric, Kristy, or anyone in the know. I plan on buying five Tenacious knives and fitting them with O-1 blades. The blades would be the same size, shape, and have the Spyderco round hole, but no markings. The rest of the Tenacious would be stock. Is there something I need to do (legally) before selling these semi-custom knives? They would be advertised as a Spyderco Tenacious with custom O-1 blade steel, and made clear that they do not carry a warranty. I know that Sal is very good when it comes to making sure makers / manufacturers get credit where it's due, and I'm trying to do the same.
 
Spyderco does license knife makers who use the Spyderhole opener. Given that you're customizing the knives for resale, I'd say you need to obtain one.

Maybe a PM(or email) to Kristi or Sal over at the Spyderco forums will head you in the right direction.



What I think might cause an issue is that they will be sold into the outside world. Who knows in a few years where they could end up. Although you have the best of intentions, Im not sure how they would feel.

I'll PM Sal and see how much this license costs. I have no problem giving him the credit that's due, but something tells me I don't have enough money to obtain a license to use his copyrighted material. If that's the case, I'll use the steel for a different knife. Would a license be necessary to make just one or two of these and keep them for myself, without selling them?

No, you can make whatever you want for personal use. You just can't profit from the design. You can even give them away as gifts. Nobody can tell you not to drill a hole in some O1 and put in into an existing blade.
