Hey guys, I had a quick question. How does one go about copyrighting knife designs? I assume you have to formally register it, but do you send photos of the knife, a description of it or what? Thanks.

I hate to tell you this- but your should probably consult a patent attorney.

I am not sure if knife designs are copyrightable; if there is something new and innovative, it might merit a patent. The NAMES of knives can be trademarked. The attorneys get together and check if your design/innovation/name is significantly different from other knives and merits its own special official place in the knife world.

This can be tricky, and sometimes dirty work (you know, what attorneys are good at)

Knife designs are very copyrightable.

In fact, you have an automatic copyright on any creative expression you make. There is no longer a need to register a copyright (this went away when the US harmonized our intellectual property laws with Europe's.)

You have to do two things. First "assert" your copyright. This simply means that when you present your designs in public, a picture here on the forum, for example, you should note "Design and picture copyright (c) 2002 by Tim ToolHead." Second, you have to defend your copyright. If you see a violation, you have to pursue that matter.

If you think that your designs have some value, then you should explore the full range of intellectual property protections available through copyrights, trademarks, and patents with a lawyer specialized in this area of law.
