Cuda Maxx legality in Texas

A friend purchased a Cuda Max w/blade length just under 5.5 inches in effort to carry legal knife in Texas. Can anyone tell me if Texas considers this knife a switchblade because of the way it opens. (hopefully not!)
 
The cuda maxx isn't an auto so your friends should be good to go in Texas.

If the blade has only one sharpened edge, it's good to go. If a knife can be opened by gravity or centrifugal force, it is defined as illegal, but I have never heard of anyone being arrested for carrying a locking-blade knife that could be flipped open. I suppose it could happen. Balisongs are illegal in Texas because they can be opened with centrifugal force, but balisongs have no spring which must be overcome to flip the blade open. Most locking blades do have some tension on the blade, which IMHO is what keeps them legal in Texas.
 
I ran a search on Cuda Maxx and stumbled across this thread. I would just like to add that while technically fully legal according to Texas law, the Cuda Maxx rides the legal/illegal line so finely that some Cops may hassle you about it not knowing any better. The blade is right at the legal limit and being able to easily flip a 5.5 inch blade open could give some Cops the willys. My best friend got pulled over in Manor TX. with a Kershaw Blackhawk and sure enough was hassled because of the spring assisted opening which in the officer's mind was an auto. I have noticed that in rural Texas, laws like these are far more relaxed and your knife will not be as frowned upon, but if your in metro Houston, Dallas, Austin, etc., and he wants to look at your Maxx be prepared to deal with an officer who will give you a hard time because it's not exactly a practical pocket knife and more like a deadly weapon. I do carry my Maxx with me all over Texas because the chance of the above scenario is slim at best, but nevertheless I am prepared for the 1/2 hour explanation of Texas law to the officer about how my Cuda Maxx is fully legal. Just a heads up. ;)
