My girlfriend pointed out the Lone Wolf D/A Diablo Automatic as a knife she really liked, and since I'm trying to get her more into knives, any blade she takes an interest in is one I'm interested in... I am wondering if anyone knows the legality of owning and carrying one of these knives in CA? The blade is longer than 3'' which, in my understanding of the law (2" max.) makes the knife illegal, although since it can be operated manually, where exactly does this knife fall?? Any help or insight appreciated!!

Thanks,
Jack

It's an automatic so it is a "switchblade" under California's law (Penal Code 653k and 21510). Merely having the capability of manual operation is irrelevant.

It is legal to own any switchblade and keep at home in CA under the law, but if the blade is over 2" long, carrying on your person or in the passenger area of a car is illegal.

Furthermore, obtaining it legally would be more difficult that you may think. Under federal law, autos cannot be sold over state lines, and it is illegal in CA for anyone to sell autos over 2". Neither law directly affects you as the buyer, but you would have only two choices if you wanted to obtain one:
1. Travel to another state where sale of autos is legal, and bring it back (this does not count as "interstate commerce" under the federal law).
2. Find a seller online who is willing to break the law and sell anyway, risking state and/or federal prosecution in the process. Granted, enforcement of these seller laws is quite poor, but it's up to you and them if the risk is worth it.
