Do Your Homework, or, SFSU Knife Regulations

I had found out recently, on the "Do you carry at school" thread, that folding knives are CA state legal at universities. I still didn't carry though, because even if it's not illegal, it isn't worth getting kicked out of school for. Well today I was bored at work so I looked up the SFSU's rules, as well as reviewed state law and city law, so here's what I found:

CA state penal code 626.10 (b) only bans fixed blades over 2 1/2" from college campuses (the only state law differentiating universities from anywhere else)

SFSU's website, prohibits the following:

i. Knowing possession or use of explosives, dangerous chemicals, or deadly weapons on campus property or at a campus function, without prior authorization of the campus president.

3. The term "deadly weapons" includes any instrument or weapon of the kind commonly known as a blackjack, sling shot, billy, sandclub, sandbag, metal knuckles, any dirk, dagger, switchblade knife, pistol, revolver, or any other firearm, any knife having a blade longer than five inches, any razor with an unguarded blade, and any metal pipe or bar used or intended to be used as a club.

So folders under 5" are a go.

San Francisco Municipal Code Article 17, Sect. 1291. Prohibiting Loitering While Carrying Concealed Weapons, shouldn't be a problem if you're a student and on campus, but it only covers concealed blades over 3", you can see the full text at: http://nt2.scbbs.com/cgi-bin/om_isa...ec. 1291&softpage=PL_frame#JUMPDEST_Sec. 1291

I called the University Police, to make sure I hadn't missed anything, and I was told that the limit is 3.5". When I asked where that was written, the student assistant on the phone was told to tell me "state law." Well, folks, state law doesn't say that, so I am happy to have learned that it is both state legal and ok by school rules for me to carry a folding knife w/a blade under 5" to school.

If you don't go to SFSU, do your homework thoroughly, you may be pleasantly surprised by what you find.

On a side note, I had assumed that both the laws and rules were far more strict than they actually are. I imagine that many other people make the same assumption. It would be interesting to find out why this is, and what its other implications are.

As I've said before, "I might obey the law, I might break the law, I'd at least like to know which I'm doing."

Interesting.

Under state law, even the Sifu is OK for university carry. It looks like the SFSU rules are just a hair stricter.

Note that "dirk/dagger" is clearly defined under Penal Code 12020(24). Since SFSU doesn't define these terms, the Penal Code defintions apply. And under those, a closed folder isn't a dirk or dagger. So the Cold Steel Gunsite is about the most potent folder you can carry under SFSU rules.

Gentleman, there was photo of the various knives taken by LEOs at SFSU. Mostly hunting/survival FBs.
 
Thanks Jason for the research and Jim for the clarifications. I've always wondered whether it was o.k. or not to carry a Sebenza on the SFSU campus, and now I know I can (knock on wood). Now about a Halo III...

Don't forget, San Francisco has a HUGE homeless population, as does Berkeley. The UC Berkeley police are constantly dealing with homeless, I'd think SF would be the same or worse...and whenever SFPD busts a bum for anything, they strip 'em of knives, SOP.

In other words, if SFSU campus cops have a pile of junk confiscated knives, one guess where 90% or more came from.

Whoever else goes to SFSU, email me (medusaoblongata@hotmail.com) so we can meet up on campus some time this semester. An SFSU, or SF/Bay Area knife knut club/meeting/whatever would be great.

Jim - San Francisco has a huge homelessness problem, but SFSU doesn't. Because of the area it is in, there are very few homeless around campus, FYI.

Jason, it was in the school paper. Ugh.

Jim, he's right. Homelessness around the school is nil (only one guy comes and sits).

However, there has been too much crime occurring there IMHO.

 
"Bums" with knives ...

If you don't have a house or apartment or fleabag hotel to sleep in, wouldn't you be just plain stupid to camp on the street or in an alley without some sort of knife? If camping in the woods is a "reasonable purpose" for having a knife in the eyes of most authority figures, why the **** isn't camping in the city a "reasonable purpose!?!?!

Well, actually I sort of know why. And the city council here in Los Angeles is now working on a city ordinance to impose a $1,000 fine or jail time for urinating or defecating outdoors within city limits.

I guess they want to force all the "bums" to go home.

Yes, James, it would be pretty stupid to camp anywhere w/o a knife. And many parts of the City it seems would be stupid to go to without a knife, never mind sleeping there. But "bums" get whatever kind of mistreatment people want to give them, and they can't say or do much about it, especially when those people are cops.
