eBay Settles Spyderco Counterfeit Lawsuit

Good news, I despise fake knives and fake anything else on there, they could stop most of that if they wanted to and cared about their end buyers!
 
We don't know the detail of the settlement, but as the article says, 'According to eCommerce watchdog The Counterfeit Report, though eBay is settling lawsuits it hasn’t changed its behavior.'

How do you enforce private seller from selling counterfeit product? Person can claim they didn't know. Short of sending the product through Spyderco's policing department before it makes it to the customer, I don't see a way.
 
So eBay will still be shit. Gotcha.

So basically eBay wants money and for them to stop counterfeiters from selling would slow there profits. Money is king over anything else no matter how wrong it is.

This behavior from eBay and others is wrong. Yet $ signs is all that matters. Now every one sells copies of products because of these stupid sites that think its okay cause they are making money to rip off other folks design language.

Where does it stop?

That ain't stopping sites like DH Gate, Aliexpress and Alibaba from selling outright couterfeits and looks like it's not even stopping ebay.
 
anycal, they can’t stop it all, but they could do way better!

They make money wheather the product is fake or not, until there is financial incentive to stop, why would they?? Moral accountability?? Haha!!

I wish all manufacturers who are getting ripped off would sue them and the factories that make that crap!

more people should step up like spyderco did with ebay,as we all hear pay for the real deal and most dislike fakes.

I'd be a happy man if Sal told us that the settlement was large enough to be painful to eBay.
 
Its a very complex problem. Right now lots of the big "aggregate retailers" as in places where products are sold from many seller/product streams, are all facing a credibility problem. But also, with most consumers valuing price over all other considerations, its going to be hard to fight against that momentum. Ultimately though until we see a a consumer protection issue crop up with it, I don't know what else is to be done besides just keep the fight up anywhere we can.

I'm pretty sure that all fakes cost ebay and the other companies in revenue, if they could solve it, I feel like they would.
 
Even if the only agreement is to make them more responsive to reported violators this could be a nice win for Spyderco. As noted this is a tough nut to crack when dealing with constantly listed new items and dealers.

Well, as i remember this one was already the second lawsuit settled by ebay back in 2017. They also had a lawsuit dated back from 2015, against a phone accessory maker, as i remember it was Wimo Labs. Well, i remember how someome was saying that after the lawsuit was settled, the ''general story'' remained the same. I guess it was eCommerce watchdog The Counterfeit Report, they said this.
 
“eBay Inc. and Spyderco Inc. have amicably resolved, on confidential terms, the issues raised in Civil Action No. 17-cv-01751-KLM (D.Colo.),” Spyderco wrote in a statement after it withdrew its lawsuit against the eCommerce company.

In July, Spyderco sued eBay alleging that eBay didn’t take “the reasonable means” to halt services to sellers of counterfeit Spyderco knives. The lawsuit also claimed that eBay knowingly ignored complaints of intellectual property infringement and that the presence of counterfeit Spyderco products in eBay listings caused confusion for consumers and damaged Spyderco’s reputation.

This is at least the second counterfeit-related lawsuit that eBay settled this year. In June, they also came to terms with Irvine, CA-based phone accessory maker Wimo Labs, putting the August 2015 lawsuit to bed.

According to eCommerce watchdog The Counterfeit Report, though eBay is settling lawsuits it hasn’t changed its behavior. “The plaintiffs change, but the story remains the same – eBay won’t knock off the knockoffs on its websites,” they wrote. KnifeNews reached out to eBay, but the eCommerce giant wouldn’t comment on the settlement. In the past, eBay has justified its internal counterfeit screening practices and vowed to defend them in court.

Spyderco is also taking Kittery Trading Post owner Kevin Inc. to task for the sale of fake Spyderco knives. The knife company’s first filing in Colorado was dismissed for Lack of Personal Jurisdiction and Improper Venue, but in August Spyderco refiled in Kevin Inc.’s home state of Maine.
 
Hiw would eBay even know what is real and what is fake? I would hate to have a real one up for sale and well meaning quasi-expert report it and it gets taken down.

You can take a factory fresh knife of any brand from an authorized dealer, post a pic here or on Facebook and half the replies say fake, the other half good to go, its real.

Tough to enforce
