Emerson Liner Lock Problem/Question...

I just recieved a NIB Emerson CQC-13 in a trade for services... I was playing around with the wave opening and discovered when the knife is opened "with gusto" I'll say, the liner travels too far over to the right and sticks, I need to get a tool and knock it back over before I can close the knife... Is there anything I can do about this, or is this something I need to send it in to have corrected? See pictures below:

Sometimes a simple disassembly and reassembly will correct the problem. Failing that, EKI will take care of you.
 
+ 1 What A.P.F. said. When you put it back together, leave everything about 1/4 turn loose from snug. See what it looks like. Slowly begin tightening the scales first then the pivot about 1/8 turn at a time. If that doesn't change the lock up then send it back to Emerson.
