If I want to make a folder or two for myself "not for sale" or any profitable act, I would like to know if Emerson Inc. would sale or give me the permit?

Sincere.

I would imagine that would need to be done directly through contact with EKI. Not through here.

I believe as long as you are not "profiting" off the wave, you may make them, from what I read on other threads. But as stated, it'd be better to directly contact EKI

You are pretty much free to make what ever knife you want for yourself, as long as you do not start selling them. I am not sure why you called the Wave, a Wave Feather.

Are you planning on modifying the original wave?

I'm almost certain he meant feature. English is not his first language if I'm not mistaken.

I would say NO just on the fact that your asking for them to "sell or give you a permit." Why would you need a permit for personal use? Now that this thread can be used as proof, if EKI sees any products from you out on the market they will seek legal action immediately.

Thanks shinyedges) I did mean feature.

I think you take it way on negative side.

My country, Thailand, is one of the worst place not far behind China about patent protection laws...
I'm asking here because I'm not very familiar with US patent laws and I'm sincerely respected to EKI... As I stated, this is not for profitable.
I just want to make sure if I can use it for my personal made and show it on my Instagram or whatever without to worry about patent complain.

Believe me that if I really want to make profit out of the wave feature I wouldn't ask here in the first place... US patent laws almost meant nothing to countries like China or Thailand... Bad people won't give a shit.

Good luck pursuing him in Thailand, dude said personal use and seems sincere. If he wanted to counterfeit the wave or Emerson knives he would just do it and you or EKI probably couldn't do a damn thing about it. Truth of the matter is US corporations have a hard time enforcing patent laws on China, Thailand and others.

Shqxk, good on you for at least asking and now you know for personal use do as you please.

My comment wasn't to offend you and believe me that patent infringement takes place all over the world and not just China. EKI deals with it and defends it on a daily basis so understand that they will not let anyone use it.

It seems lately that no matter what I say here people will take it the wrong way or get offended. I'll try to be straight forward. If it's for personal use then you wouldn't need permission. Of course EKI can't go after everyone for patent infringement.

Spyderco might be the most counterfeited knife company out there and they spend lots $ attempting to stop counterfeiters. Pretending you can pursue everyone anywhere is preposterous.

Well not to throw any wrenches in this simple discussion that has turned into a war of words. Counterfitters will copy anything they can make a buck off of.

Last weekend I was at a gun show in the Valley of the Sun one of the usual knife vendors was there with his counterfit Benchmades Infidels & Microtech Ultra Tech copies. The show promoter does not care this guy sell counterfits. He only care about selling table space, and getting people throught the gate who pay admission.

People who do not know the difference between the real thing, and the counterfits were per the normal paying good money for copies complete with faux factory boxes, faux factory instruction & warranty cards.

The sad part is if the unsuspecting buyer has a problem the real deal company will return the item that was sent in for warranty repair with a letter saying you have a counterfit. Then the buy will be made at Benchmade or Microtech.

Go to any Mexican border town and you will see all sort of counterfit designer purses, Oakley sunglasses, NBA, NFL, MLB, NHL Merchandise. People buy it, bring it back right in front of the U.S. Customer Service Officer manning the port of entry. Who for the most part turn a blind eye, as they primary mission is to stop illegal aliens & illegal drugs from crossing the border.

The deal with patents, copyrights, trademarks, and other intellectual property. Your copyrights, patents, and trade make are only as secure as you have the funds to stop the counterfitters.

Speaking of counterfits here is a little link I found that is very eye opening.

This goes beyond imitation being the highest form of flattery...NOT.
