Fake Infidel

Traded 2 Spydercos to a guy for a infidel and im furious over it because I believe it’s fake, however I have never owned one so it’s hard to tell , they make some decent fakes the main problem is this knife only fully strikes less then half the time as you do it? Any suggestions or could it just be an issue I should address with Benchmade? I want to send it in but don’t want to look like a fool
 
According to Benchmades warranty policy, they are rather strict when it comes to who can send them a switchblade for warranty work. You have to either meet certain requirements (military, LEO, etc), or you need to ship the knife through an authorized Benchmade dealer.

Also, according to their warranty, they reserve the right to impound and destroy any counterfeit Benchmade knife they receive.


Unfortunately there are a lot of fake Infidels out there, and a lot of unscrupulous people.

Actually, Benchmade told me once that anyone can ship the knife directly to Benchmade; but they can only ship automatic knives back to an authorized dealer, a policeman or 1st responder, soldier, or government official with whom their job is the procurement of such items.

Nope. Other places/dealers are not as strict about documenting your status to buy one. Benchmade can't dictate what individuals can do, just what they are not allowed to do themselves. They say they don't care how you send the knife to them, as long as they comply with the law when they ship them back. And they do say they reserve the right to keep, destroy, or remove trademarks from fakes if they are sent into them - their choice.

Also, the restriction applies only to regulations about shipping automatic openers, not about what stores or people can do when selling them over the counter in person.

Benchmade is very touchy about shipping auto openers across state lines to unauthorized people. I read a post, I think on Blade forums by the way, where someone shipped an auto opener to Benchmade for warranty work. Benchmade destroyed it and told him they did him a favor. He was pissed but Benchmade can take a hit if they ship it back to him since they are not allowed to engage in the unlawful commerce of shipping auto openers across state lines to entities that don't meet the exclusion criteria to do this kind of business. I suppose the favor they referred to MAY BE that the individual may live in an area where his/her local laws prohibit it or other ? In any case they still have to meet federal guidelines whether the state that they ship it back to allows auto openers or not. He should have considered he may have put Benchmade between a rock and a hard place.

Auto openers (as well as gravity knives and butterfly knives) are also generally a no no as far as using USPS for shipping. There is a separate set of laws that apply specifically to using the USPS (US postal service) to ship these items apart from the other federal regulations. That means using Fedex, UPS, anything other than USPS, is the safest way to keep from getting entangled in these laws in cases where shipping is otherwise legal of course.

My impression is Benchmade will go by the book on these matters and will not cut corners or play around in grey areas of the law. Others take their chances. I can't fault Benchmade for that.

In a nutshell don't ship your auto opener to Benchmade for warranty work unless your are absolutely positive you meet all the exemption criteria for shipping or you won't get it back.

Benchmade is perfectly happy to ship auto openers back to the closest authorized dealer of the knife owner, so the owner just has to make the proper arrangements over the phone beforehand, and use that dealer's address as the return address.
