I was wondering if i carry my Benchmade Fecas on my belt, and have my shirt over it and cover the knife. Does this make it illegal and constitute "concealment"?

I believe in California that constitutes "Felony".

What you describe is clearly a concealed fixed blade = illegal in California.

I read a forum post some years back where some cops followed someone with a fixed blade on his belt. (Returning from a trip or something.) The knife WAS clearly visable, however the cops were following him to see if his jacket, at any given time, covered the handle. They were waiting to arrest him if it did.

Be careful.

I hate to even talk about this type of absurd legislation but I gotta ask if there is anyone that knows how strict the standard is for concealed. Is an in the pocket sheath considered concealed? I am specifically asking about the Razel, it comes with a clip that hold it inside the pocket just like a folder. I don't consider that concealed but would an LEO? I plan on asking one or two myself, I just want to be prepared for the shock whichever answer I get.
Thanks.

I've wondered the same - please post your results.

Here's my guess:
Assuming you're using the pocket sheath that comes with the Razel, I'm guessing the average LEO would let it go. The handle at least is in clear view (again, assuming no shirt hanging down). While the law specifically mentions carrying on the belt, I believe case law has expanded that to being clearly visible somewhere on the person (I remember someone posting that here sometime back).

Add to that the utilitarian design of the knife as a whole, and assuming you don't look or act like an orc, and I'm guessing most LEOs would pass on it.

These are a fixed blade pocket knife. They are felony in California. I have read that Ron Clark stated that the a 2" fixed blade in the pocket is ok. I have reservations about that though. True that 2" Ca specials auto are ok. I imagine that this would also cover butterfly knife also. Even carrying a folder in a locked position with a pocket sheath is still a felony. Best to play it safe and carry on your belt with it out in the open.

Any thoughts on this scenario:

Fixed knife attached to your belt with the handle fully exposed like a good citizen should have it... but the tip of the sheath is tucked into one of your pockets? What the majority of the sheath is tucked into your pocket?

what if you have the fixed blade buried in a backpack you are carrying?
would that be considered a concealed carry..... hmmmmmmm?

No, because its not readily accessible. The law is concerned with criminals on the streets or in a bars pulling a concealed blade and stabbing someone, not campers or hunters out in the woods. Of course your mileage may vary.

Just carry a folder. Fixed blades in the mountains only. Do not carry fixed blades in an urban environment. You could be asking for trouble from people other than the police.

the law cant cover every conceiveable scenario. its generally considered concealed if carried on a person out of plain view and readily available. pocket sheaths where the handle is still visible might be okay to me, however consider that many situations are interpreted differently by different people. one officer might let the pocket sheath go, while another will consider it concealed. i would recommend belt carry with shirt tucked in.
