fixed or folder?

It is a open folder, unless you are in California, in which case it is a fixed blade

As I understand it, many state laws exempt folders carried in the Closed position from concealed weapons laws, as they are not considered readily available for use as weapons. Carrying a folder in the locked and open position would be interpreted the same as carrying a fixed blade. These restrictions of fixed blade carry are ridiculous, imo, and reflect a lack of understanding on the part of lawmakers.

Nonetheless, carrying a folder in an open and locked position is kind of strange. Why not carry a fixed blade instead? Your legal consequences will still be the same.

If you're talking about when you get picked up as a criminal, I believe it will be frowned upon, and considered as an indicator of a predisposition for seeking trouble.

The only reason for carrying a folder opened is, that it would still count as a folder. But as this is not the case... yes it does not make sense now. Thanks for the information.

In Mass any device which allows you to draw a folder in the open position is illegal. I assume this applies to Gerber and MOD sheaths which allow either folded or open carry. Oddly though, there is no law I can find against carrying a fixed blade. Not that LEO's appreciate the public doing it, but if it's not illegal, why not just carry a fixed blade.

I'm in total agreement with Paracelsus on this.

However, since you live in Bayern (Bavaria), you might have a slightly different set of laws, regarding this issue, than we do in "the states".

Raptor: yes, here it isn't a problem to carry a fixed blade at all. I wanted to know about the american laws.
