Florida Knife Laws

Could anyone let me know what the knife laws are like for Florida? I will be moving from New Jersey to Florida in a month and would appreciate knowing what is legal and what is not? For example, would a Rekat Sifu be considered illegal for carry? If so, could anyone also recommend a folder that would be legal and also would be usable as a primary carry for self defense and usable as a tool as well?

Florida carry law is a mess. Everything is considered a weapon except a "common pocketknife." When I asked two leo's, my local sheriff's office, my local PD, and the FDLE what a common pocket knife was, i got about two dozen differnt answers. Short answer is "it depends." Basically, the law is written so that the arresting officer can charge you with concealed weapon first degree misdemeanor (1 yr in prison) if he/she feels like it, or doesn't have to.

If you're moving to FL on a permanent basis the first thing you should do is get to a gun show and take the CCW class. in FLorida, it's a true concealed WEAPON permit which also applies to all cutlery (yes, to the best of my knowledge, autos are legal statewide, but individual counties and cities may have other ordinances). Basically, if you can conceal it, you can carry it. Check out Chapter 790 of the florida statutes. http://www.leg.state.fl.us

So in answer to your question, if you are walking around without a ccw and you get stopped with a Sifu, I would bet good money you're gonna be in trouble. Get a ccw. Takes 90 days and all the hassles disappear. Until then, anything past an SAK is pushing it (in the opinions of the several leo's with whom I have spoken).

PS, don't let the yahoos in the knife stores, etc tell you about the "four-finger rule" regarding blade length. There is NO statute about length, etc on the books. See the link above. Hope this helps.

Thanks for the response. I appreciate the info that you gave me. I will be moving to Florida on a permanent basis. So for me, CCW is the route to take. After taking the ccw class at the gunshow, how difficult is it to obtain a ccw license? Here in New Jersey, I know it's next to impossible to obtain one..

Arvind, in Orange County there is no specific law pertaining to length of knife blade. Whether you are carrying concealed or not is up to the cop that searches you.

I too advise a concealed carry permit. Florida is a shall issue state. That means unless they find a real reason to deny a permit,(previus convictions,etc)then they MUST issue a permit. You will have to take the course and submit a picture of the right size, and a set of fingerprints, and thats it. If your approved they mail you your permit in 90 days.

If you don't have a permit I would suggest only carrying innocent appearing folders with a blade of less than four inches. The deputies I've spoken with all seem to have it in their heads that anything longer than 4 inches is more a weapon than a tool.

Thanks Wdg123. My record is clean, only thing I have are a couple of speeding tickets and those are about two years ago. Aside from that I have nothing. Once I get there, I'll try getting to a gun show and take the course. I have never been to one before so it will also give me a chance to see how many different kinds of knives are there and possibly also meet people from BladeForums as well.
