Florida knife laws?

Hey some of us have jobs smartypants.

Anyway, short answer: Yes, the Tenacious is legal to carry in Florida even if concealed.

Florida Statute 790.001 does not consider a "common pocketknife" to be a weapon. Because common pocket knives are not weapons, they are legal to carry concealed, with of course the exception of places were knives are normally prohibited, such as schools, airports (since 9/11) and courthouses.

What is a "common pocket knife?" It is not defined anywhere in the law, and no maximum length is specified. However a case in 1997, LB v. State, made a ruling that it is a knife that folds into it's handle and has a blade less than 4 inches long.

I think that vague laws like the one in Florida are so ambiguous as to be a danger to persons carrying a blade. There is way too much left up to the interpretation of what is a "common pocket knife", regardless of case law. This interpretation will be left up to the LEO on the street at the time of the encounter, with his/her interpretation dependent on too many variables. You may beat the charge, but you can't beat the ride.
