Just watchin the news, and they mentioned gill nets being used by some dorks at a local reservoir.

The newscaster made specific mention that even possession, let alone use, is illegal in Ohio.

Has anyone ever used one in a survival situation, and subsequently been charged under possession/use laws??

Seems stupid to me to charge/convict in those situations, but.......

Well, some have cut trees in U.S. Park and Forest land in survival situations and have not been charged. Generally, the law recognizes the defense of "necessity" in criminal cases. If you life is at stake, it is not a crime to cut that tree. I presume (with all attendant risks) that same reasoning would apply to catching a fish unlawfully - or shooting a deer out of season, without a license, or with an unlwful weapon.

One extra problem with gill nets is that they are unlwful to possess, but why would anyone know if its tucked down in the bottom of your pack?

A gill net is illegal because it works too d##n well -- a good thing in a long-term survival situation -- IF such a situation seems at all possible.
 
If they're illegal to possess, I wonder if they'd still write up the individual for having the net in his possession prior to the situation that made it a matter of life or death that he use the net.

They charged one guy that was lost, hungry and cold for the damage that he did a rangers station, when he tried to get in for the warmth and possible food stores. They arrested a guy that, after breaking a leg, started a fire which in turn became a nightmare because he didn't have the mobility to take proper care of it. They arrested and convicted a guy that discharged a .22 rifle to kill a coyote that was biting his 2 year old daughter in his front yard. Of course, this is California, land of the oppressed and home of the sheep.
 
Where I'm from (Michigan), it is only legal for Native Americans to own or use gill nets. It is understandable for you to be charged for having it. If I stop a burglar by stabbing him with an automatic knife (in CA or IN for example), then I'm sure I'm gonna get in trouble for having the knife. Same thing applies for unregistered handguns, assault rifles, etc. Use does not justify possession. If you really want to survive, train your body and mind, not your tools. It is important to carry the right tools, but my survival gear is EDC (fishing line, knife, sewing kit, etc.) , because you never know.
