I want to bring my S&W spring assist.
Any legal problems or am I fine?

Thanks!

Dave

Shouldn't be a problem as long as the blade is under 5.5 inches in Georgia.

My understanding is that a knife with a blade length of over 5 inches requires a Georgia Weapons Permit in order to carry. Are you sure about 5.5 being OK? That would allow me to carry my Rodan (5.25) on hiking trips.

No, you're right. I'm not sure why I typed 5.5. Anyway, here's the actual law.

O.C.G.A. § 16-11-126 (2012)

§ 16-11-126. Having or carrying handguns, long guns, or other weapons; license requirement; exceptions for homes, motor vehicles, and other locations and conditions; penalties for violations

(a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his or her home, motor vehicle, or place of business without a valid weapons carry license.

(h) (1) No person shall carry a weapon without a valid weapons carry license unless [exemptions only apply to guns].

“Weapon” means a knife or handgun. “Knife” means a cutting instrument designed for the purpose of offense and defense consisting of a blade that is greater than five inches in length which is fastened to a handle.

It's not that prohibitive. The knife has to be designed for offense or defense.

I would not like to have a judge determine the purpose for which a knife was designed. I have asked my representative in the Georgia House about changing the law to allow unrestricted blade length when carrying a knife without a weapons permit. He was surprised that there is a length restriction and said that he plans to work on having it dropped. If you agree with me, please talk with you representative or senator.
