Got upsetting news from Benchmade

Hello to all doing a little venting , complaining. Short story Benchmade Bugout bought from Smoky Mt Knife Works Nov 2021 My ex wife took my son into the store and let him pick me out a Christmas present, well it was a black Bugout, knife developed vertical play not bad but not what I thought it should have, I mailed it back to Benchmade and yes I signed the waiver on counterfeit knives, I didn't have a thought about it being a counterfeit well guess what Benchmade now has my knife their saying it is a counterfit, SMKW says without a knife to return I'm stuck, and I don't have the recipe , divorce going on at time ex said she gave him $200.00 to buy it with , he was 12 at the time, his uncle went in with him, I am at a loss, I guess or hope Benchmade has folks that know their business , all I know I have lost a knife, no returns possible. Benchmade in my opinion is loosing its reputable name and warranty to me , Beware if you send it back to them better hope their honest. Thanks Dwight

I'm sorry to hear this - I wonder if one of his friends or someone else swapped out the genuine knife with a fake. I would try hard to get a copy of the receipt from SMKW since you have the date, get the Benchmade box and instructions for the knife from your son (which can be determined if real of fake by posting pics here), and then call Benchmade and ask for Rick Young and see if he can help you. He was very helpful to me before on a different issue that he took care of (not anything like this one though).
 
i’ve heard of people buying a knife from a retailer then swapping it out with a clone then returning it to the place of purchase for a refund. if whoever takes the return isn’t paying attention or isn’t knowledgeable about benchmades then the clone could have been put back in stock and resold. i think sportsmans was the seller in the last thread i’ve seen it mentioned in, not sure it it was on bladeforums or benchmades company forum
 
It sounds like the loss happened with SMKW not Benchmade. Benchmade is only delivering the bad news. As you said, the knife was not what you thought it should have been before you sent it in.

SMKW is a large operation and they can be sloppy. When it first came out I ordered copies of the Buck Talon in black and tan from BladeHQ. The knives come with a matching color sheath. For some reason, I wasn‘t given a confirmation on the tan one, so I placed that order again with SMKW. A week later 3 knives came in. BladeHQ had correctly sent one of each knife with the corresponding sheaths. SMKW incorrectly sent a black knife with a tan sheath. So yes, their stock handling can be less than perfect.

Hello to all I am 100% sure the knife didn't get swaped while in our hands, my son said his uncle paid for it when he got to the car he showed it to his mom then put it in his back pack, and they drove home , he then came home to me that evening , he lives with me he wrapped it and put it under the tree. I still don't believe this knife was a counterfeit , I have owned hundreds of Benchmades , and walked away from hundreds of fakes, this knife wasn't a fake it was a knife with a vertical blade play problem, that I was trying to get Benchmade to correct. Thanks to everyone that's commented so far, JUST BEWARE BEFORE YOU SEND A KNIFE IN FOR ANY REASON, ITS THEIR DECISION WHETHER YOU GET IT BACK !!!!!!! (( If, I SAY If it was or is a fake my son was sold a good fake by SMKW, how it got in their possession ?

People will buy a knife from SMKW or other retailer, return it for a refund, but they put a fake in the returned box. Then the knife is re-sold to next customer. If that was the case, it should however be listed as "open box", and the clear sticker-seal on one side of the box would not be intact. If the seal is broken, you need to have an expert examine the knife to be sure it's not fake before buying.

The retailer usually doesn't not know how to detect a fake. I have caught a fake Benchmade sent to me on eBay and the seller truly did not he had a fake. I sent him pics and noted about 25 points of difference between his fake and the real one. Same with a Tanto PM2 I got off eBay. I got a refund on both. if you have hi-res pics of the knife I'd be happy to look for signs of being a fake.
 
Sorry, but your claim is weak. Benchmade is losing it's reputable name because they won't return your counterfeit knife after you explicitly agreed to allow them to keep any counterfeit knives? How does that work? What should they have done? Or are you saying they lied to you and stole your knife? And why on Earth are you returning a brand new knife to Benchmade for repair when you can easily just exchange it for a new one at SMKW? Why are you choosing a painful process over a painless one? Why are you not keeping receipts? Why not purchase items requiring protection with a credit card instead of paying cash (protects against problems with the purchase and loss of physical receipt). Why buy a $200 luxury knife for a 12 year old? I have so many questions 🤣🤣🤣.

Everyone should know this already though. You have to sign a whole form about it, like you said you did. They tell you up front, so why would it need to be announced again?

As for how it happened, most likely what people said about someone doing the swap and return scam is the most likely. This happens with big stores all the time. Here is an example from Cabela's https://www.bladeforums.com/threads/cabelas-fake.1503950/. Here's REI . I could've sworn someone even posted about this from SMKW recently but can't find it.

I absolutely guarantee Benchmade didn't keep your knife and it isn't really a fake. Your anger should be directed at SMKW and honestly maybe a bit at yourself for signing a form without reading it. Benchmade gave you the form to make sure you would know. What more could they do?

Bryan J I live 3 hrs from SMKW, I did sign the waiver , I don’t believe the knife was fake , and being a smart ass isn’t good, the knife was bought for me as a Christmas present by my son, reciept. was kept by ex wife who gave him the money , now she can’t find it.

I am going to say this you are a disgrace to bladeforums being a prick won’t get you anywhere, I wish you were my neighbor good lessons can be taught easily to your kind. !!!!!

I clearly read the form but there was no reason for me not to agree to it I didnt even think about it being fake it came from a reputable store . Their have been post before about fake spydercos being sold their, I’m looking for it , all it takes is a few bad employees and you have problems.
