Well, this goes down well. Not since the infamous 20/20 News Show did a Heavy "Hit" Piece on Martial Arts Weapons have I been as befuddled with Massachusetts...

This is equal to that...Nunchaku and the Kennedys be damned I say...errah...

I have heard persistent rumors from a Friend of mine, one Mitchell Lake, currently serving time in Massachusetts and studying for a law degree, that the Commander is illegal in that State. By default, all "Wave Operated" knives would be as well...

So, he is busy and could not find the law, I found it.

Here ya go...my New England Suspects...we are really talking about NEW England here...

Massachusetts - Chapter 269, Section 10... (b) Whoever, except as provided by law, carries on his person, or carries on his person or under his control in a vehicle, any stiletto, dagger, or a device which enables a knife with a locking blade to be drawn at a locked position, any ballistic knife..., dirk knife, any knife having a double-edged blade, or a switch knife... shall be punished by imprisonment for not less than two and one-half years nor
more than five years in the state prison... except that, if the court finds that the defendant has not been previously convicted of a felony, he may be punished by a fine of not more than fifty dollars or by imprisonment for not more than two and one-half years in a jail or house of correction.
- C. 269, Section 10... (b) Whoever, except as provided by law, carries on his person, or carries on his person or under his control in a vehicle, any stiletto, dagger, or a device which enables a knife with a locking blade to be drawn at a locked position, any ballistic knife..., dirk knife, any knife having a double-edged blade, or a switch knife, or any knife having an automatic spring release device by which the blade is released from the handle,
having a blade of over one and one-half inches... shall be punished by imprisonment for not less than two and one-half years nor more than five years in the state prison... except that, if the court finds that the defendant has not been previously convicted of a felony, he may be punished by a fine of not more than fifty dollars or by imprisonment for not more than two and one-half years in a jail or house of correction.
- C. 269, Section 12. Whoever manufactures or causes to be manufactured, or sells or exposes for sale, an instrument or weapon of the kind usually known as a dirk knife, a switch knife... or a device or case which enables a locking knife to be drawn at a locked position, any ballistic knife... shall be punished by a fine of not less than fifty nor more than one thousand dollars or by imprisonment for not more than six months...

Massachusetts Case Law:
- "Knives described as 'kitchen knife,' 'folding type knife,' and 'Swiss army knife' may not fall within category of
dangerous weapons." (1994)

Now, I'm 32 years old, I used to tote around a few knives, two good old Buck 110s namely, along with a Case Tigershark I think it was at times...

We used to use a little pumice and gun oil and work them till they would snap open like lightning and they didn't wobble none either (for you critics out there of "weebles.")

And we would look through the various gun magazines of the day and see a sheath/holster marketed for the Buck 110 and all similar-sized folders called, "The Sting," if I remember correctly.

It allowed a large folder to be drawn in the open and locked position. We all thought it was great but never ordered one.

I have since saw "Custom" renditions that were very dangerous, people made the sheath themselves and it was just plain dangerous to the User...but I digress...

All Italics, Bold and Underline have been added my moi...

The last portion regarding kitchen knives, Swiss Army Knives, etc., is puzzling...

So...what are your thoughts?

This would appear to make the Wave itself illegal on folders, don't you think?

Sort of Draconian that a man could modify certain popular folders to open this way and they would, in effect, have made a "Switchblade-grade," illegal knife...or some leatherworker or sheathmaker, that made some sort of device to open knives in the locked position...same thing...

And when you wake up tomorrow, it might be worse...

Don,
thanks for the info,I started checking on the legality of "the wave" some time back and right now it seems it will be up to the individual LEO to make the call.Just for the record I carry a SOCFK as my constant companion. So I've tried to keep up on what's going on.But it doesn't look good, because in Taxachusetts,( yeah ya got it right)EVERYTHING is in the interest of PUBLIC SAFETY.
Sorry for shouting.
BTW keep up those posts

This is the Thread in The General Forum about the Boston Globe Article where a waterhead screw**** thinks we should have knives locked away because they are more prevalent now.

They will stop at nothing to disarm you of any damned thing they can, that you can use to defend yourself.

You see where I am from? Scamdanavia, you got it, close Cousin to Taxachussets, Maryland.

Don,
Thanks for the info. I guess I should say I'm not surprised. I've been wondering when something like this was going to happen. I hope the Wave feature doesn't get too much of the media spotlight or Ernie could be forced to sell it only to LEO/Military just like Winchester had to do with the Black Talon bullet.
frown.gif

Wouldn't that just bite the big one. Except that we could sell our waved knives for mucho profit!

Here in Washington State, any of EK's models can land you a night in the pokey if you get the right cop fresh out of the academy. The law is so vague out here, that anything over 3" can get you in trouble. Ya just gotta be careful. No wave openings or wrist flicks if there is LE around.
frown.gif
Sometimes ya gotta wonder whose side the cops are on, anyway[no offense to any pro-knife LEO's]. But I digress....

I guess we're just supposed to be helpless little sheeple. Bastids!!!

"And have no fellowship with the unfruitful works of darkness, but rather reprove[expose] them." Ephesians 5:11

Now, see, I think this is a grey area in the law (so thin you can f-ing see through it, but there nonetheless). Now, the law states that it is illegal to carry something that allows you to draw the said implement of nastiness in the locked position. How well defined is "draw"? To me (and, of course, I'll bring this up, and probably STILL go to jail) the wave is in operation DURING the draw, so in essence the knife is not locked as you draw it - it only locks once the draw is complete. Now, I read the Draconic M******* law as saying it's illegal to remove the knife from the pocket locked. With the wave, you aren't (sorta).

Of course, this is all moot if you only have one arm. Cuz we all know it's legal here to own a switchblade/OTF knife/waved knife, cuz when these fun laws were written, there was no such thing as a thumb stud/spydie hole. So, if you had one arm, the only way to open your blade was by spring. Nice, huh?

Oh, oral sex is illegal here, too. (No, I'm not kidding). AND, there's still a law on the books from 1700 or so, that says if you bring a dead rat to a public official, you get $10. See, there's a bounty on rats, cuz we had a lot of 'em back then... but they haven't changed the law yet... so, I think I'll hit the sewers, and start getting a nice bag full, so I can buy my CQC6.

im sure there are alot of cops that would'nt even notice the wave on the blade. they would probrably be more concerd about the size and the look of it, dont you think..

I tend to agree. The wave is pretty softspoken, it just sits there until it is actually used, then it draws attention to itself (no pun intended, really).
The size of the blade is usually the bigger issue, in my experience.
Just don't show off the wave feature to LEOs, especially upon being pulled over.

HOLLISTER!!!

It was Judas Priest's "Breaking the Law"...of which, Beavis of Beavis & Butthead Fame chanted as he sawed a Praying Mantis in half with a chainsaw...

Heh heh heh...

Allow me to now compose a similar version of Breaking the Law by Judas Priest...for our friends in Massachusetts:

I think of all the money I was wasting
on Benchmades and Spydercos around town
all inside it's so frustrating
as the laws are fit for clowns
feel as though nobody cares
if the knife opens when I try
so I might as well begin to put
some Waves on my knife

Breaking the law...
Breaking the law...

So much for the golden knives
they think they're so smart
I've had every liner lock broken
there's anger in my heart
you don't know what it's like
two hand opening knife has no clue
if you did you'd find yourself
buying a Commander too

Breaking the law...
Breaking the law...
You don't know what it's like...

Breaking the law
