Teen Uses Sword to Capture Prison Escapee

SULLIVAN, Mo. -- Joshua Cary heard a noise in the basement, grabbed a sword from his big brother's collection and went downstairs to investigate.

The 14-year-old didn't mince words.

"I'm going to give you until the count of three to come out, or I'm going to stab you," he yelled Thursday, according to his mother, Rebecca Cary.

Soon, a handcuffed man emerged, saying, "I didn't do it."

Joshua led the man upstairs at sword-point. His mother ran outside and found police searching for an escaped prisoner. The man, Mark A. Brown, who had broken free after he was picked up on a parole violation, was taken back into custody.

Joshua's brother is a soldier stationed at Fort Riley, Kan., awaiting deployment to Iraq.

Rebecca Cary said the swords are for decoration, but noted that her older son had told Joshua he "needed to take care of his mom and sister. And he did."

Cary said she was proud of her son, who went out afterward for a celebratory night of bowling in this east-central Missouri town.

"He's always been fearless," Cary said. "I hope he grows out of that soon."

:confused: Ummm...yeah. It's a crying shame he wasn't a wuss. :rolleyes:

Personally I hope the kid grows out of swords and into guns like his soldier brother - this society could use some more fearless men. I like this kid too.

i'm surprised he wasn't arrested for yielding a deadly weapon in his own home and instilling too much fear into a trespasser. think of the potential trauma the escapee might have suffered...not to mention, someone around there ought to arrest the kid's brother for not having safety locks on those swords. kid could have poked his eye out.

i sure hope they had permits for those swords.

i'm on mom's side...that kid should have gotten under the bed and called 911 and waited 45 minutes for someone qualified to handle this situation....where do these people get off taking self-defense into their own hands?

i'm joking... but what's scary is that there are probably A LOT of people who agree with what i said...

FWIW according to law, once the kid said that statement the handcuffed man could have legally killed him in self-defense (i.e. deployed deadly force to mitigate an immediate and grave threat to his life by a young man who had motivation (intent), means, and opportunity). The justifications for deployment of deadly force work the same, regardless of who is posing the threat. Whether we agree with that perspective is a seperate conversation.

Personally, I'm glad the situation went down the way it did, ending with the perp in custody and nobody hurt. IMHO the kid deserves our best congratulations for having the cojones to act on behalf of his family.
 
Depends on the state. Here for instance, once he was in the house the kid was justified in fearing for his life or grievous bodily harm" Virginia for all it's faults is one of those states where one is NOT under any obligation to retreat from his home.
The handcuffed man on the other hand would have no justification to attack in self defense since it was not his home and he was under a citizens arrest. Va is also one of the few states that has codified the common law right for a citizen to arrest a felon!
Now as far as Mo. law is concerned, I don't know. I suspect they have similar laws.

None of that is the point though. It's nice to see a young man stand up on his two hind legs instead of worrying about getting in trouble for doing the right thing.

Hi Peter, These days I'm one of many out of work engineers in the Seattle area. ;) Like I say, I applaud the kid. Whether I think the letter of law based on the kid's words is justifiable would be a seperate discussion.
 
Love It! What a champ. Him and his brother are what made this country great. Well, them and a few other "types". But great for him and us. Here in Colorado, a conservative state witht a huge liberal city, we have a so called "make my day" law. This young man, fearing for his life, could use deadly force to protect himself and his family. Kinda like it should be , huh. Thankfully he wasnt bringing a "knife to a gun fight". Anyhow,,,, kudos to him for having the audacity to stand up for his right to be safe in his own home.

Good for him, I'm glad he kept his chin up and rooted that guy out.

In the mom's defense, I don't think she's hoping he'll stop protecting the family. Take it from a former "fearless kid," I used to worry my mom to death because I would do all these crazy things...now that I'm a little older I can understand the nerves a kid can tweak in his/her parents by never being held up by fear.

I think now that everything is said and done, and OKAY...she's just hoping he doesn't take those cojones and go too far some day.

I know, nobody cares...but somebody's gotta' stick up for a mom every now and then ;)

I posted this even though it is a little off subject from a custom makers standpoint for a couple of reasons. The first is that it does make me happy to see that there are a few kids out there that have the nerve to not dial 911 and cringe in the old safe room until they realize that the police are not coming any time soon.
I'm glad there wasn't more of the "you'll shoot your eye out" discussion. That belongs on another forum.

The second and more important to makers, is to emphasize that knives and swords are still viable weapons under the right circumstances. For every good design that is out there, there are 100 that are nothing but wicked looking clubs. I agree that in that case I would have chosen a gun. I also have them stashed every few feet in the house. ....But...when the kids were younger I did not have loaded guns everywhere and when they became teenagers:grumpy: I was afraid to sleep with a loaded handgun because they would come in after I fell asleep. I had a 22 inch sword that I made just to tuck under the edge of the bed and the nearest gun was across the room.

The best weapon in the world is the one you have now. Even those of us that do carry firearms, leave them off some times.
A number of years ago I taught self defense classes. They were a little unusual because I based the curriculum on my experience and the experience of others I brought in. I am always a little irritated at the "Experts" that teach knife fighting but have never been in a knife fight.

At that time, I suggested the students carry a fairly small spyderco. The reason is it was easy to open, small enough to always have with you, legal and very effective. I also stressed the importance of never threating or trying to scare an attacker off. When he became an attacker, the knife should be used and not shown.

I only know of one student that ever used this technique. It saved his life I think. He was in a parking lot and a man with a gun approached him, the BG pointed the gun at him, took two more steps and got cut from his stomach to his sternum. My student ran off and called the cops and the other guy lived. `Also went to jail.

Point is here that a practical design is always best. It doesn't have to be wicked looking because it's not for show. This is one of the reasons I like Jerry Hossem's swords. They are just plain practical!

here I believe
if he is caught in the house dump him just don't let him out side
if you do then you have a problem with the law,
so it's better to ,,,,well,,, render him useless
to anyone ever again. my home is my home and God help
the intruder regardless to the laws..

mark: Don't think some *$@& lawyer didn't think the same thing.

I wouldn't be surprised if the mother got a visit from the Dept. of Children Services because she left those lethal weapons accessable to a minor. I had to deal with those a$$holes before, considered my son's mothers home to be unsafe at the time so he moved in with me. During the time period the guy tried to get me to go to court over custody, at the same time telling her that I was saying I wanted to do it. Playing both sides of the coin burned him that time, cause while we aren't friends, we still were very open and honest when it comes to our son. So we let him dig a hole for himself then contacted the state.
