I live in California specifically Hayward and i was wondering about the knife laws out here. I recently received a 10 inch Smith and Wesson limited issue Texas Hold 'Em knife with a sheath. I heard that as long as it is in its sheath and your not brandishing then its legal. Anyone have any answers?

Its also legal if you keep it at home :)
Brandishing is when you're showing it to people, as to scare/intimidate
(you can find definition at http://leginfo.ca.gov/ ).
Weapon doesn't even have to be real to be charged for brandishing.

If you're using the knife, then it can be outside of the sheath :)

City code

knife site:www.hayward-ca.gov/municipal/
http://www.hayward-ca.gov/municipal/hmcPDM.shtm
http://www.hayward-ca.gov/municipal/HMCWEB/DangerousWeapons.pdf
Defines "Dangerous Weapons"
Any knife having a blade three inches or more in length, or any snap-blade or
spring-blade knife regardless of the length of the blade.
but goes on to say that it applies to sale/furnishing... for/to minors

county code (bascially the same, you can't sell/give... to minors )
http://www.acgov.org/admin/admincode/Alameda_County_General_Ordinance_Code/Title_9/12/050.html
http://www.acgov.org/admin/admincode/Alameda_County_General_Ordinance_Code/Title_9/12/060.html

so it looks as you're good to go

Your county's code is full of junk (the whole "Saturday night specials” handguns." section)

of course, I am not a lawyer, this is not legal advice ...
Enjoy :)

If you open carry a 10 inch blade around, its all but guaranteed that you'll be hassled by the local law enforcement, and you'll most likely even get detained/ arrested sooner or later, even though it may be technically legal. If you absolutely insist on carrying it, by all means do (live and learn, after all), but don't forget to carry a copy of the California knife laws, with the sections/ excerpts that are relavent to you highlighted, in your wallet as well. That way, when the po-po tries to tell you that your knife isn't legal to carry (this is bound to happen if you're carrying a 10 inch blade, as the vast majority of cops don't know squat about knife laws), you can show him the law and kindly explain to him/ her that your knife is actually perfectly legal to carry. Then, you can see what its like to ride in the back of a police cruiser, because the nice officer just arrested you for going "armed with intent," despite your knife technically being legal. Note sarcasm--> After all, the only reason you would be carrying THAT big of a knife around, is if you intended to hurt someone with it. <--Note sacasm

EDIT: Sorry if I came across a little strong, I was just outlining the most probable outcome of openly carrying a 10 inch bowie knife on your belt in California. Another likely outcome is that you would be arrested for "disturbing the peace," as many people will freak out, call the police, confront you, ect. if they notice a big blade on your hip.

Thanks for your output, I greatly appreciate it. It looks like im going to have to leave this one at home unless I want one of those free one way taxi rides in the back of a cruiser.

California is a great place for a folder! Emerson is based in the LA area, and look what he puts out....not much else except waved folders that are <4". I can get a waved folder into action quicker than a fixed blade....

The only place I carry a fixed blade is out in the bush, where concealment isn't ever an issue.
