Is a Benchmade Presidio 520SBK considered a gravity knife?

It depends on a law enforcement officer that checks it out when its found on your person I guess.

Technically speaking if a blade is not resistant to gravity in the closed position when the knife is held with the blade spine pointing down then its a gravity knife.

If a liner or frame lock and the detent ball is not doing what it was designed to do its a gravity knife by definition. Some officers call anything that can be flicked open by momentum a gravity knife while others just hold the knife upside down to see if the blade falls down exposing the point or if it can be made to fall open with very slight subtle movement of the body with the blade in the closed position. If the detent is set right it should resist this but even a good detent or a strong spring on certain tip heavy blades in lockbacks can be flicked open which opens up a big gray area for interpretation of the definition.
