Is my Benchmade 940 out of spec or fake??

I recently bought a 940 from an authorized dealer and I love it. The one issue is the clip tension. There's very clearly a gap where the clip is supposed to lay against the scale.

At first, I thought that the clip might be out of spec, but I order two new ones from Benchmade with the same story.

I really don't need the clip; I generally let the 940 sit loose in my pocket. My concern is that gun shop I bought the knife from either intentionally sold me a fake, or someone previously bought the knife from them, swapped it out with a fake one, and returned it.

There are not any glaring details that would suggest it's fake, but after doing a lot of research online, these damn counterfeits have gotten really good. Here's an example of how good these counterfeiters are getting:

Any thoughts would be appreciated.
 
i wouldn’t worry about your knife being fake due to just the clip being loose. sometimes they do come that way.

an easy way to fix it is to remove the clip, turn it around backwards to where it’s sticking out from the end of the knife and install the two putter screws, then carefully bend the clip down until you achieve the desired amount of tension.
 
As others have said, a loose clip doesn't indicate anything other than a loose fitting clip. It happens sometimes and is easy to fix.
 
I'd be careful carrying an axis lock free in the pocket unless you have the pivot tightened pretty good. Imo the axis lock is the least retention when closed off any type.

Picture? I would find that a bit odd. It suggests that the scales may not have been machined right so that the clip is at the right spot. But we can't tell that from your description.

Small gaps between the clip and scale aren't uncommon because there are different types of clips and because there are different thicknesses of pants that require different spring tension.

Imgur is a good photo hosting sight if you don't want a paid membership to upload directly to the website.

Not fake. If it bothers you bend it down as previously suggested.

If you’re uncomfortable fixing these clips by yourself, consider contacting Benchmade, and ask for new clips. They will send them to you free of charge (last I checked.) But bending them should be an easy fix, something even I can do—and I can barely hang a picture.

I though it was normal for Benchmade clips to have a little bit of space between the clip and scale when tightened firmly. It doesn’t bother me especially if it’s g10 material.
 
Not fake, just more questionable QC...took me 4 tries to buy a 940-1 at two stores for various issues (and my standards aren’t that high!)
 
I have two BM's and both clips are tight as hell . The one on my Bug Out is so tight that it take two hands to slip it into my jeans pocket.
