Is the Benchmade AFCK NYC Legal?

Can someone tell me if the blade length of the Benchmade AFCK is under 4"? Please measure from the handle to the blade tip. Thanks!

It's 3.9" and although according to penal law as a folder its legal, the police like to make their own interpretations according to intent. Jersey police can be a real pain in the butt but New York police usually will not give you a problem if you're not in trouble.
