Is this a legal EDC in NYC?

Folks,

I think I have read every post on NYC and can't seem to come to a conclusion. I want to EDC an old fashioned swing guard pocket knife but can't recall if the fact that it locks open is an issue in NYC. The blade is under 4", single edge and absolutely cannot be flicked open. It can only be opened with the finger nail groove.

I couldn't recall if the locking part automatically disqualifies the knife. If it's a problem I will try and find one that does not lock, although it's been tough to find one.

What do you mean by a "swing guard?" Very old knives didn't actually "lock" but rather had a tab sticking out that you held down once the knife was open. This is sometimes called a "peasant knife" and such would be legal in NYC because it's not a lock. Similarly, a backspring is not considered a "lock." However, almost any true lock makes it a gravity knife due to the judicial corruption permitting the "flick test" by grasping the blade and swinging violently using the handle's mass to open it. Though if this move is truly impossible with your knife, it would pass as legal.

Please note that any knife showing visibly is illegal, even if under 4", considering a boy scout was arrested for a swiss army knife on his keychain.
 
The lock is fine, so long at it can't be flicked open, including being grabbed by the blade and flailed around dramatically like some cops like to do. As was said, just make sure its hidden, even the "bulge" showing in your pocket can count if they say they can tell its a knife. Maybe someday they'll get around to writing a law that makes sense. They did recently rewrite the old gravity knife law, but the new language leaves just as much gray area, obviously written by people who don't know about knives.
 
Even if the knife you are talking about is not easily opened I would be worried that the swing guard may cause it to fall under the term" Dirk" in a legal setting. I know the type of knife you are talking about and they are too easily looked at as a weapon by people who are looking for a weapon if you get my meaning.

Examples of swing guard knives are the Case Cheetah as well as some of the old Italian-style switchblades.

I personally wouldn't risk taking any type of locking knife into NYC. And being a swing guard would likely make it look even more like a "weapon" to a cop, anyway.

Thanks! I was not familiar with them. The way it was phrased in the question made it sound like some kind of locking mechanism.
 
Sounds like N.Y.C. In a place where you may need something for protection from thugs you are not allowed to protect yourself. You can bet the thugs will have a heck of a knife to rob or assault you with however!!
 
Cities with knife and gun restrictions that are so ridiculous have the highest crime levels.
Left wing politicians will never get it.
