Is this a talon hole copy? It is placed slightly "higher", but looks fishy...

Actual Trademark infringement would be if they called it a "Talon Hole".

Utility patent would be another thing.

So wait... aren't you and Ed saying the opposite? He's saying infringement occurs when they call it a Talon Hole. You're saying its when a hole is placed in the guard regardless of what they call it. Just curious, is all...

if you read the actual trademark filing found here:

you'll find that there is no mention of any kind of name anywhere in it. No word association is involved in the trademark, it is a visually identifying feature, a "hole in the rearward portion of the blade". This could mean any position in the ricasso, however the accompanying image with the trademark is that of a basic 3, limiting the holes placement to being 'in the guard'.
 
There are utilitarian reasons for having a hole or two in the ricasso. Survival type knives routinely have them. Like LVC said, once that hole is down in the guard area it is the visually identifiable feature of the Busse Combat trademark. The knife in question appears to me to have its hole stradling that very zone between the body of the ricasso and the guard. Tough one.

I did read it. I get that. What I'm commenting on, is Jerry says EdWood is correct, but then clarifies with the opposite.

Ahhh... wait a minute.... Jerry says "INcorrect"... never mind. Ya know I read that 5 times and saw it as "you are correct my friend" Carry on...
