Izula in Florida

I posted this question in the knife laws, but maybe there are some rat-folk from the florida area who can help me out:

I'm making a business trip to florida next week...
I'm a little concerned about the nature of the open carry of weapons thing.
I typically edc a small sebenza, and that is likely within the umbrella of a common pocket knife...but I'm not 100% sure I want to take that in checked baggage with the TSA nazi patrol on full alert.
I was thinking of pocketing my izula (only $50 as opposed to $300), but would that be considered a common pocket knife? Or would I have to carry that open on my belt?
 
I don't know if TSA enforces Florida law. If it's in your checked bag, I'm assuming you could pack any sized blade because they're not trying to determine if you'll be carrying it or storing it somewhere.
As far as carry goes, My LEO friends say the definition of common pocket knife is kind of up to their discretion. If it's out of sight and you aren't causing trouble, I'd say you're good to go. But I'm just a simple man, not a lawyer, LEO or politician.
 
There have been a few cases where a folder of 3 3/4 or 4 inches was found to be a common pocket knife. The statute is not clear on what a "common pocket knife" is, but a small Sebenza should be fine.

I would stay away from pocket carrying a Izula and here's why...

"Weapon" means any dirk, knife, metallic knuckles, slungshot, billie, tear gas gun, chemical weapon or device, or other deadly weapon except a firearm or a common pocketknife, plastic knife, or blunt-bladed table knife.

Since they cover knives in that definition I assume a fixed blade knife carried in your pocket could be considered a concealed weapon. I mean its concealed from plain view and the statute says a knife can be a weapon.

I dont recall ever seeing anything about open carry of a fixed blade knife.
 
I see you're in MA so I'm guessing you don't have a CCW?

A concealed weapons license solves most problems a person would run into...

My real concern with the flying (which someone had brought up in the law forum) is the baggage handlers. They open bags all the time. I was traveling extensively with co-workers, and this one woman had her checked bag opened and checked everytime, as they left a little certificate in her bag to let her know. She carried a notebook with some private info written on the back, online passwords and the like. One day when we got to work after a flight, she notices that the pages are all ripped out. The little certificate was still there though.

I don't trust any of them farther than i can throw them.
 
Well, good you brought that up. Hubby and I will visit the US. He found out a classmate of his is living in Alaska, so we will start there ...

We'll rent a mobile home most likely, and as we like to be spontaneous I'll be bound to overlook some state we're entering I wonder if any fixed knife would be ok as long as it stays in the kitchen drawer of said mobile home while we're moving through one of the states with strikter laws?

Easy fix, take a padlock and run it through the pinky hole on your Izula and attach it somewhere on the inside of the suitcase :cool:

I will agree with this statement. I carry a small fixed blade in my pocket every day (usually my Izula) and have never even had an eyebrow raised when I've used them in public. I also usually carry a large-ish folder in the other pocket (Spyderco Military/Endura/Superhawk/Kris) and also, have not had any eyebrows raised when using them. I also have my CCW so don't worry too much about it anyway, but in my experience, once you have the Izula in your hand, it's so unassuming, most people would consider it a "common pocket knife" and wouldn't go calling the cops on you for using it for EDC chores.

The other option would be to pick up an Opinel (around $10.00) and use it for out of state EDC. That way you still have a very capable and totally legal knife but won't have the stress of worrying about it's safety/security in transit or at your destination. If it gets swiped or lost, it's easy enough to replace. I love my #8. :)

In FL it covers most weapons in general. If you look at my previous post it has the link for what is considered a weapon by FL statutes. I think we have reciprocity with about 35 other states and people can get a non resident CCW.

I love the concealed carry laws down here...now if they would only let me carry to class!

I agree with this. Just hit the first Walmart you see and pick up a Kershaw for $35. There's been a few times I've done that when I've flown to Indiana because I didn't want to chance losing a knife to the TSA or bag handlers.

If you are coming to the Gainesville area I'll let you borrow one of my folders. I have more than I can carry in one day so I doubt I'd miss just one.

a ccw in FL covers all weapons like guns and otf autos. FL really has no laws about carry ( it's up to the leo) you can carry an auto or fixed blade in pocket or exposed no problem unless you cause problems... the Izula should be a non issue as I carry bigger fixed blades than that here.
 
In MA it is called a LTC (license to carry firearms(aka as hanguns), and there are two types A(for any thing that can take more then ten rounds) & B(under ten rounds, and most of the time restricted to target and hunting, no CCW on person)), IT DOES NOT COVER ANY OTHER WEAPON. Only firearms (and Mace/pepper spray).

We also have a FID card for long arms and mace. Oh and lets not for get the AG's office has a list of "BAD" guns (like Glock, Springfield XD's, etc) that the sheeple / subjects are not allowed to own (but cops can, go figure). The AG's office tried to pass a law banning hundreds of handguns they called "Saturday night specials" when the law was shot down he then took the same law he just lost on and made it fall under the AG's offices "consumer protection regulations". POW, instant handgun ban!!!! We also have an assault weapons ban.

You also can not carry on your person any type of impact weapon (this can include Maglites in some situations), daggers, switchblades, etc., I'm pretty sure there is a ban on butter knives too.

As for FL, they have a much less restrictive system down there. With the size of the Izula I would belt carry it (there fore it is not concealed). I have belt carried (open carried) in FL before and had know problem at all. You could try asking the AG's, local or county LE. (here in MA if you call any of them they tell you to hire an attorney to "interpret' the law for you. I know this for a fact as I have called them on several occasions, "I'm sorry sir, we do not give out legal advice". WTF)

I did have a cop here in MA question me once on my Izula. I have a copy of the state law in my wallet and bag just in case. He wanted to see the knife (fishing to see if it was double sided, aka as illegal), once he saw the blade and the size he was ok with it, and was asking a lot of questions about it (I think we may have a convert). Also it is not a knife it is a tool (not a weapon), like an emergency seat belt cutter. :D

look at the top of the molle teklok, you will see the loop in the lanyard I throw over the top.

I also wrap my Izula in red, purple or safety orange para cord if I think it is going to be questioned (depending on where I am going). Oh and DO NOT use a lanyard with a skull on the end, as cool as it is and I do love them, think "low key" not a weapon. A skull implies that it is a weapon of some kind to some, but a bright colored wrapped handle and lanyard projects "tool" "helpful" etc., I know it is nuts but it works. If your right handed, wear it on your left side, now it is not easy to draw and thus is not a weapon (to someone that has no knife fighting experience or training, most cops don't).

Oh, and thanks now I gotta go to the hospital, you know after 4 hours. lol:eek:

The 1911's with a non resident LTC you could, the others prob not (god I the loony left in this state)
