Kerhsaw Scallion Pivot Problem

Recently bought a Kershaw Scallion. Love it! However, it does not open all the way with a push of the assisted open button. I've put a few drops of 3n1 oil, but that seemed to do nothing. But here's the real issue. The non torx side of the pivot moves when I try to undo the torx side. Any suggestions on how to secure the other side of the pivot?

1-take the clip off
2-place a rubber band between the screws,
3-reattach the clip and screws
4-adjust pivot at will
