Knife carry while on Informal probabtion

I have a question for those of you who may know. Long story short. I am on Informal probation, its for a misdemeanor. An Orange County sheriff found like half of a percocet in the back of my truck, and went to jail. It was a bummer. Got a Lawyer and what not, it was some bull poop. Anyways, I was in the court room listening to everyone get their probation orders and the judge would read them aloud. About 90% of them that I paid attention to said something like no weapons of any kind. But for some reason the judge forgot mine and left...not joking. The bailiff had to go search for mine. But they do not have in the order anywhere stating I cannot have a knife or "weapon" on my person or near me. Nothing. Any LEO's advice would help. I mean what would you think if you came upon a situation like that. I usually carry a mini cqc 7 or my SnG, nothing to crazy and all within limit i think. Thank you
 
you should ask your probation officer....if he ask what do you need it for tell him you have to use it as a tool and not a weapon.
 
Your probation officer can show up at your house at any unexpected time and confiscate your knives and then charge you with violating probation.
 
No probation officer, I'm on informal

If you're on probation period they can search your residence any time with out a warrant.

They could just send a random probation officer to check on you and do a search & seizure.

First of all, did the "half of percocet" really belong to you? Or did a relative, friend, or co-worker that had a prescription for it may have dropped it in your vehicle accidentally while you were giving him/her a ride? I ask this because a wife here in MA was recently arrested for possession of ammunition without an FID card after her husband left a box of shotgun shells in the family car (her husband has a gun permit and is a hunter). She got caught when she ran a stop sign, got pulled over, and reached into the glove box for the registration. A box of 12-gauge shells were left in the glove box by hubby and the wife ended up taking a trip to the police station and court in handcuffs. Judge dismissed case the next day at her arraignment after hubby explained that the ammo belonged to him. You may have grounds for appeal. Don't let a narcotics possession conviction ruin your life.
As to the knife, I would say do not carry any type, not even a SAK while on probation. If your work requires the use of a knife, then your employer should notify the judge who sentenced you, along with the clerk of the court, via certified mail that you need to possess and use a certain type of knife to do your job. You and your supervisor may be ordered to appear in court to answer questions concerning this request. It likely won't be a problem if you are a butcher, commercial fisherman, electrician, chef/cook, etc. But definitely clear it through the court. Don't take a chance with your freedom by violating your probation.

Hi brand new member so hope im not intruding In Pa. You cant carry unless its for work
About what I figured. State laws do vary and people on probation or parole agree to give up certain "rights" in exchange for their freedom. In such cases, it is better to have all of the cards face-up on the table. All it would take is one dickhead cop with an attitude and the OP would end up in jail for violating his probation. If he clears it through the court in advance, preferably in writing, then his butt is covered. By the way, welcome to Bladeforums!
 
Well, the percocet was mine from when I squashed my finger and got stitches. However it was months old and was all tattered. Knowing what I know now, the Sheriff was more than likely out of line as far what he can and can't do, but that is in the past now. Its been a year now. Im In California so I dont know how that differs, thought I'd ask. Thanks
 
Are you saying there is no paperwork saying your are on probation? If there is no "record" of your probabtion, then....

but if there is a record, stay away from the knives.

If you got stitches, then you received treatment in a hospital ER and an emergency room doctor prescribed the drug to kill the pain of your injury. A prescription is on file somewhere. Your lawyer, if he/she was worth their salt, would have produced this documentation in court. You should see about getting your conviction overturned on the grounds of ineffective counsel. You do not want a drug conviction of any type on your record. It can negatively impact your future in profound ways. You got good advice about knife possession, though. As long as you are still on probation, be careful. If you get your conviction overturned, make double sure that your record is either sealed or expunged, depending upon what California law allows. Everything has been set in stone. INformal does not require that you check in or anything like that. I have my probation orders, It says what I must do and cannot do which is next to nothing. Does not say I cannot furnish a knife. Maybe Ill call a law man.
 
at this point i the last thing i would be worried about is carrying a knife. try to get the papers showing it was yours to get it off your record.
