New York Update - First Test Case

We now have our first test case! Knife Rights is proud to come to the aid of an honest citizen accused of unlawfully possessing a Gerber folding pocketknife. The Gerber is alleged by DA Vance to be a gravity knife and the charge carries a potential one year in jail. There's not a lot I can say publicly at this point, but we will have a good deal more to say on this in the near future. Stay tuned...

Doug, it maybe well worth while to find out why the DA handled this as a DP ( declined posecution). I know we all believe that is not a gravity knife, however the officer flicked it open with ease and that has held up in court before. It would have appeared that the knife owner was headed to getting a sumons for the exposed knife, but his attitude turned it into an arrest for a gravity knife. The officer tried several times to correct the knife owner, and I believe the officer had little desire to arrest him, but the guy just did get the messgae to be quite.

Any updates on the case you are defending?
 
There seems to be little rhyme or reason to why some accused get off, some get an ACD or some get the book thrown at them.

I can't really discuss at this time the details of the case we are working on. One of the frustrations of going to court is sometimes you just can't say what or as much as you'd like. :rolleyes:

I can say that we have had a number of individuals contact us recently who have been arrested and are looking for a capable defense against the charges.
 
Thanks form the added info. I can tell you that in Brooklyn last month a pre trial hearing determined that a flickable knife was a gravity knife to that judge. I too was a gerber but the gator model. I hope I am wrong, but my sense of things in the NYC court system, is that your case will most likely have to go the Court of Appeals before you get any clear defintion of a gravity knife. It would of course be wonderful for the defendant to the the DA DP the case, but that would not serve your cause well. As for the ACDs, well that is only given when a conditional guilty plea is entered, so once again good for the defendant, but no so good for the cause of clearing up the mess at hand. Good luck and keep up the good fight! Keep us posted to the degree you can.

I also wanted to add that due to a recent increase in robberies in NYC, CPW arrests are now a sort after catagory. That means that OPP has sent out the word that weapon arrests are a good source of positive PR to respond to the increase in robberies that has spiked the last two months. This will mean more looking for pocket clips, and those "stop and frisk" stops will most likely result in more arrests for any weapons found including knives of course.

What a sorry-assed state of affairs....we`ll all have to resort to carrying steak knives, telling any inquisitive authorities "Yes sir, I am on my way to lunch/dinner at my favorite steak house, and their knives are dull, so I have to bring my own !"
