I live in New York City, and I keep hearing different people say that knives (even switchblades) with blades that are less than 4 inches long are not illegal to carry. I read the state law about illegal weapons and there is no mention of blade length that I can find. Anyone know what the truth is to this?

Yup just read one of the stickies at the top of this forum. There will be a section about new york city in there.

NYC Admin COde states must be under 4" if it is a locking blade. It must also be carried concealled. No belt pouch or exposed pocket clip. As for the rest of the state, there is no size limit. The ONLY time a gravity knife or switchblade can be carried by a non LEO, is when you are actively fishing or hunting and going to and from that activelity. You must also have a license to do that activity. That is the law......Watch out for "gravity" knives as the NYPD states them to be any knife that can be flicked open.....alot of lock backs fall into this definition......

Hey Tom, thanks for the answer. I'm still a little confused though. You mean that in NYC ALL switchblades over 4in are always illegal, and blades under 4in can only be carried for hunting? Or that all switchblades under 4in are always LEGAL, and blades OVER 4in can only be carried for hunting? Also, can you possibly post a link to where you're getting this from? Thank a lot, man.

Switchblades are illegal in new york unless you are a police or military person.

New York - Penal Law Section 265.01. A person is guilty of
criminal possession of a weapon in the fourth degree when:
(1) He possesses any firearm, electronic dart gun, electronic stun
gun, gravity knife, switchblade knife, pilum ballistic knife, metal
knuckle knife, cane sword, billy, blackjack, bludgeon, metal knuckles,
chuka stick, sand bag, sandclub, wrist-brace type slingshot or
slungshot, shirken or "Kung Fu star"; or
(2) He possesses any dagger, dangerous knife, dirk, razor, stiletto,
imitation pistol, or any other dangerous or deadly instrument or weapon
with intent to use the same unlawfully against another; or

RedEdge77 keep going to 265.20 which list exceptions #6 will show you that a non LEO can carry one while hunting, fishing, trapping.....I won many lunches from other LEO who swore that #6 did not exist until they read it.
Switchblades are illegal at any lenght unless you are a LEO, or the above listed exception.......RedEdge77 too bad I did not bet you lunch....lol

New York overall has surprisingly reasonable knife laws. A lot of folks around the USA don't realize that a whole lot of the state is "country" rather than "city".

When I travel to New York City I carry an Endura 3 - blade length 3-15/16" - as my biggest folding blade.

Dang, i missed that part. I'm sending lunch telepathically......;)

Can you carry a 3in/under "Fixed Blade" in a sheath, concealed? Say, one that hangs around your neck like a necklace, for self defence? Or does it have to be able to be seen in three directions, like in VA?

In NY, I mean.

Fixed blades do not have a size limit in NY...That being said case law would indicate that a blade over 12" overall in lenght will mostly likely be considered a "dangerous knife" a very loose term in the Penal law. There is no bias towards concealled carry or exposed carry in NY State, only NYC states it must not be visible to the public, so it has to be concealled. I do wish the laws were not so differing from state to state as in NYC you can carry a lock blade up to 4" concealled and be legal, but violate the law in another state with far more lax gun laws......I don't get that one ????

It's nice that NYS does not have the wacky Laws NYC has!
NYC is Liberal central! :barf:
