is there a law out there that says you have the right to face the person that makes statements against you?? if you know it or just could point me in the right direction I would like to thank you. I live in a mobile home park and the new management has told me I can't have my scooter on the drive way. By the way this is a self own park. Some people here own a share and others don’t. I am a share owner. A friend did some buying when K-Mart was closing down some stores in the local area. He got 2 scooters and I got 1 that is nothing but parts. I got told he can come one my drive way and take them from me to get rid of them and there is nothing I can do about it too. The 2 scooter that my friend got I went out and bought batteries for them. 1 of them I use it almost every day. the other 1 for some reason the brand new batteries are not getting a charge so it does not work. my friend is coming over to see what he can do about it for me. can he really come over and just take them from me like that because they are on my drive way?? first thing Thursday I am going down to the police station and see what they are going to do about it. I traded a bunch of knives for the one that I got working.

My suggestion is to get sorted out in your head what is relevant and what isn't, and when you go to the police station only tell them the relevant facts.
 
Did you sign an association agreement?
My mom lives in a trailer park and she had to sign one.
Management is very strict there. Even the township police that patrol the trailer park report infractions to management.
She hates it but it was her choice to move there and she is not about to move in with me!
 
I'm not entirely sure I understand your situation, but let me say that NO ONE has the legal right to take your personal property without your consent or without a warrant (although in some places it is legal to take things out of someones trash).

At the very least, if someone takes your property it is petty theft. But depending on the dollar value of the property it could be grand theft.

Of course, if you signed any kind of contract or agreement (lease, HOA agreement, etc) stating that under certain conditions that someone (landlord, etc) shall have the right to remove property if that property violates the terms of the agreement that you signed, that's a different story (that could be considered "consent"). Such a contract may or may not hold up in court. If you signed any such agreement, read it carefully. But no matter what it says, don't just assume that you have no rights. If someone takes your property and refuses to give it back, call the cops and file charges.

If you believe that someone is going to take your property without your permission, take the necessary steps to protect said property. If you can't protect the property, and if video surveilance is not an option, it's always a good idea to keep receipts and take pictures of your valuables.

Personally, if someone TOOK anything from me, even something as simple as my morning newspaper, I would insist on filing charges.
 
I am going to the police station first thing in the morning and ask them what the deal is. Then I am going to ask for a police report about what they said. Then I am going to get a copy of that report and when we have the monthly share holders meeting I am going down there with it and request a copy of the rules that said he can do that. I didn’t sign a contract saying any thing like that. I am looking at a law suit of hostile toward a handicap person. I just got told of a person down the street from me that has a bunch of junk on there drive way but there truck blocks it from view so you cant see it from the street. There is a bunch of people that live here that has the scooters too and they don’t even work. Why is he not jumping on them?? I remember they put a rule in place that all commercial cars or trucks that had writing on the side had to cover the writing up. I know of 2 electrical vans that are not doing it. This meeting is going to be fun. I am think of calling channel 9 news about this. I wonder if they will try to film it for the news that they put on TV.
 
Well, the right to confront your accuser is the 6th Ammendment to the US Constitution. But I'm not sure how it applies to your scooter problem.
 
I can barley walk. I am SSI disabled and I am a disabled VET too. now there is alot of people that have them. you are telling me a manger of a mobile home park can take that right away from you?? it is not like I have them trash up on my drive way. the VA is trying to get me the peace that fits on your truck so you can take it with you when you go shopping and out.

I only know what you've shared but it sounds like someone is trying to bully you.

I am going to the police and file that report then I am going to call TV station 9 and see what they can do about it. I have seen them before one time. I was thinking about small claims court about hostile towards the handicap. I think I should have the same rights as anyone else does.
 
I just found a place on the net about free legal advice. I sign up and asked them about my rights. we shall see what they have to say.
 
Now this is the site to belong to. They have lawyers that post on there board just like this one about legal advice. By him saying he can take my property he has committed a crime. I now haft to decide if how far I am willing to take this. the state of Florida and the federal government has me protected by his threat of taking my property.
There is nothing to buy or sell on this site. It is nothing but lawyers answering your legal questions. I have to ask spark if I can release the name of this site on the board. That way if any one need legal advice they can go to this site.

I REALLY hate it when people try to use their authority or supposed power of their position to bully or take advantage of others. Whether they are landlords, property managers, security guards, bad cops, or any government agents. Such people often prey on the general fear of authority many people have, the fear of possible negative repercussions (real or imaginary), and the common desire not to cause trouble, make a big deal out of it, or draw attention to themselves. The bullies and scoundrels of the world take advantage of the fact that many people simply don't know their rights and they often succeed simply because people consider it easier to do nothing and don't want to go through the trouble to fight for their basic rights, or don't even know that they can.

And it really burns me up when people take other peoples property. Perhaps it's because I grew up poor (and have always pretty much been poor) but the way I see it, some people in this world only have so much, and when someone takes something from them, even if it seems like a little, to the person it was taken from it's really a lot.

well my friend just left. we took a peace off of the one that was being strip for parts and put it in the other one that had problems and it works perfect now. I have it plug in and it is already fully charge and the parts one has been strip and the frame and other junk is out by the front for them to pick up for garbage day. now I have 2 of them. I talk to the people that make and sell these. they will not sell to me only companys. $4,000.00 each plus you have to buy a min of 10 of them and pay for shipping. They did say they would sell me parts for it or the truck carrier for it.
 
well they fired the so called manger over it. channel 9 ask if they need to send a news team down there to get them back. I hope the new manger does not start all over again. we will see.

there is a web site. I will not name the site but it is free to join. no they are not selling anything there. what you do is sigh up on the site and when you have a question about the law or what you can do about something you post is on the site. Lawyer’s around the good old USA read the post and answer it for you. all for free. they gave me a link to the housing people for the feds and state so I can file with them and they come in and do something about it. it is all for free unless you need to hire one of them.
